N-400 denied ... need advice???

In fact, if I remember correctly, the question is "Are you a citizen of the United States of America" YES or NO. Kinda hard to miss that one.
Sure, if that question is there and the person reading it understands English, there is no excuse for answering YES.
You must be a lot less cynical than me I guess.
I don't know if that question was on the form in October 2004, or if the OP answered YES. I'm not jumping to conclusions without knowing both those facts.
 
Some people don't understand English very well.

Not the OP. You can read his original post to judge his English proficiency.

But we all can make mistakes no matter how absurd if we look back.

Best case scenario, you can naturalize 5 years from date you registered (so this year).

The OPs statutory period is 3 years, not 5. USCIS already made the mistake of denying OP on 5 years statutory period instead of 3.

I don't understand the need of some posters to crucify the OP when the mistake of registering to vote occurred outside the statutory period.

Waiting my interview

Thanks guys for all the nice comments. :)

I thought registering to vote is one in a life time, and when I become a citizen I can vote.

Also I thought I will be Okay by canceling my registration at Los Angeles County and providing an evidence of the consolation to the Immigration officer.

Did I mention that I am an Arabic, Muslim and from the Middle East (Jordan). :(

Do you think they just strongly denied me for my race?! :eek:
 
I remember way back (1997) when I first got my US drivers license how they automatically registered me to vote without me signing any declaration of US citizenship. When they handed me the license, the next they had asked me is what party I was affiliated with. It was then I realized that they were trying to add my name to voter registration list automatically and I had to remind them I am not allowed to vote due to being a non citizen. Needless to say they never added me after I told them this.
This goes to show that an non citizen can unknowingly register to vote without ever having signed a sworn statement.
 
Good find. I even see the notation in the corner saying it was last updated in 2003, so it would have looked just like this in October 2004 when the OP registered.


Update: I see the form itself does not show anything about the revision date, only the instructions are dated. So I don't know if the same form was exactly like this in 2003/2004, or if the OP received the instruction sheets at the office where he registered.

Are you sure you did check the Box B instead of just Box A of Part 2 question on N-400?

No, registering to vote or actual voting during the statutory period is an automatic denial unless you have a convincing reason to exonerate yourself (like if the form did not say anything about being a US citizen, or noncitizens are allowed to vote in local elections in your jurisdiction).

Same here. Elsewhere in the forum this was already discussed but I do remember that NYS had a tear-off portion of the DMV form that asked you to register. Also, when you change your address on your driver's license in NJ on-line, they ask you a question about making the same address change on your voter registration. The only option is yes/no. Nothing about N/A or some other choice. So go figure.

Perhaps they don't say Yes to that question on N-400. AND USCIS
will not look up registration rec ords of all 50 states. the OP paid a price for his honesty

I WON , I GOT IT , I received my Oath ceremony today 03/16/09. WOW :D

I am scheduled for Oath Ceremony on the 22nd of April 2009. WOW :p

I overturned the immigration denial. During the hearing interview, the immigration supervisor agreed with me about the 3 years statutory period…. He said that the first denial decision was a mistake because I don’t fit the 5 years statutory period. :D

Special thanks go to Bobsmyth. He told me about the immigration mistake. And he encouraged me to appeal (God bless you). Without his discovery I might be ending waiting another 5 years. :)

Yes, I went to the interview with a lawyer. The lawyer is a lady from the Philippines (i am Arabic). She wrote a good “declaration” and a good “brief statement in support of request for a hearing on a decision in naturalization proceeding”.

The interview took around three minutes.
 
Congratulations Pilot9288!! Now if only you can recoup the money that USCIS robbed from you by having to file an appeal for their incompetence.:rolleyes:
