People divorce... and then even remarry the same person. Can any body question the legitimacy of their marriage ? In your case, divorce did not even occur.
I do not mean to be disrespectful to any one, since people on this forum help laymen to go through intricacies of immigration process. However, IMHO, many posters here are overly docile/paranoid. Besides, they have a causal knowledge of immigration law, but are not as well versed as an immigration attorney. In my opinion, since your case is a bit complicated, you are not getting a right advice here. I will advise you to consult an immigration Lawyer, actually 2 or 3 of them, and then decide what you want to do.
Every thing has a specific scope of service. You cannot use a car if you have to fly. You need to sit in a plane.
