N-400 and Stipulation of discontinuance / Divorce

People divorce... and then even remarry the same person. Can any body question the legitimacy of their marriage ? In your case, divorce did not even occur.

I do not mean to be disrespectful to any one, since people on this forum help laymen to go through intricacies of immigration process. However, IMHO, many posters here are overly docile/paranoid. Besides, they have a causal knowledge of immigration law, but are not as well versed as an immigration attorney. In my opinion, since your case is a bit complicated, you are not getting a right advice here. I will advise you to consult an immigration Lawyer, actually 2 or 3 of them, and then decide what you want to do.

Every thing has a specific scope of service. You cannot use a car if you have to fly. You need to sit in a plane.
 
They allow for situations beyond your control like school, economy or military deployments when it comes to marital union.

Whether the divorce occurred or not is not the issue.
Again, immigration law has a different definition of what marital union is from what you might have. Some think it's sufficient just to be legally married without consequence. Marriage based applications are targeted exactly for this reason since applicants have an incorrect notion of how USCIS defines martial union.
Of course, it goes without saying that it's a good idea to get an opinion of several legal professionals before deciding what course of action you will take instead of relying solely on the information you find here.
 
Yo, I remember that we collected letters from friends etc to "prove" we actually maintain a married life. But that was for the GC.

After filing for N400 on sept 2008, last jan 2009 my wife (usc) filed for divorce.
Now we reconciled and we agreed to sign a STIPULATION of discontinuance: this will (the law office say) withdraw the divorce originally filed:

Is this true?: a petition of discontinuation will withdraw
For good the divorce paper?

In this case should I explain the all story to the immigration officer that will interview me?

I know this may be a divorce question matter but I've nowhere else to ask;
Some people here already know my case;

Pls advice

Did you ask an immigration lawyer?? (this might be your best bet now)

also has your wife signed the papers to cancel the divorce? ( you mentioned she is-- or will be in Turkey soon )

You also mentioned going to the fingerprint office to ask advice did you get an answer from them?

I am putting posts from this and the other board together to better understand your story..

I did not ask a lawyer yet (if I would I wouldn't be posting here back and forth don't you think so?....)
I also did not go to the FP office asking for advice;

Me and my wife today called the law office handling the divorce; we said we want to reconcile and they ask us to
Send a formal notarized request called "stipulation of discontinuance": we both have to sign it and send it back;

I do believe this will discontinue (or withdraw) the divorce proceedings;

I need some kind of paper evidence to show the iO that we reconciled; my wife is going to Europe next April nd will not go to the interview with me;

I need to know if this discontinuancy is effectively a CANCELLATION of all divorce RECORDS?

Do I need an attorney with me at the interview?

That's not really true is it? I've been following your case with interest on another forum where you have been getting similar advise.
I'd stop over analysing if I were you :)

Yes and in different boards too,, he claims he wants answers but REFUSES to eithier get them PROPERLY ( like a LAWYER ) or listen to any advice from posters but continues on a quest to get answers :confused::confused:

hey hoping 2009, wow whos is refusing to get them properly???

my case has been updated with a petition of discontinuancy of divorce
im not refusing anything here and stop criticizing!

you are not im my situation, if im in another forum also than its my business

my mistake here is i need to get the advice of an attorney and stop asking
questions on this forums

People are trying to help you but you get very upset when you don't get the answer you want to hear --- so here it goes,,,

You will not be asked anything at all,,

When you go there with a SMILE and a shake of hands they will have your certificate READY and you will be VERY happy...
