My very first TN was denied

it was back in 2005. it was evaluation issue, I fixed and came back and got my TN, after that I got 4 more TNs and successfully able to get my GC in 2008.

The issue is every time when I get back from overseas they pull me for the secondary inspection.
This time I asked the officer why I was pulled and he told me that I have past immigration violations. I asked him what violation, and he told me that I was denied TN entry back in 2005.

Is there any way to fix this because I think this is the main reason that system won't give me automatic approval and the officer at desk have to send me for secondary inspection.

thanks

The "system" never grants autoamtic entry. The officer is free to question you however he sees fit.

And you can answer him the way you have, and gain entry.

Playing devil's advocate here. Even GC holders are not guaranteed entry into the country. Only citizens are. We are not privy to what is mentioned in the OP's "system" history. It may be something that needs to be verified everytime the OP seeks re-entry. Most likely it is a case of an agent going overboard, but I will not call it ridiculous.

Whoa, I mised the part about already having GC!
That is ridiculous.

...not if it occured previous to GC. Sounds more like a case CBP going rogue after DHS and State have already blessed off.
Jerks.

I concur. CBP is usually on a power high. I know someone who got his GC via marriage (in 1984) and is still married to the same lady. His history is very simple. Came on F-1. Met his future wife at university and got married. Everytime he re-enters the country he is asked how he got his GC and if he is still married to his sponsor wife. This is more than 2 decades after he naturalised :)

The reason I used the "system approval" term because the officer at desk was ready to stamp my passport and then he saw something on the screen and he put the stamp away and told me to follow him for secondary inspection.

I was keep checking and searching and found out that I need to take this to the higher level.

For the sake of others who also looking for the solution here it is.

Go to http://www.dhs.gov/dhs-trip and Apply for Redress.

I did the same, I will post the results when I get back from my next trip.

I think its something flag in the system which prevent the automatic system approval and send you to the secondary inspection.

Thanks,
Asim
