My green card expire while waiting for decision, what to do?

Why wouldn't the states follow the federal government in their determination of applicant's immigration status? The USCIS clearly states that the PR status does not expire even if the GC expires. What is so hard to understand about this?

The state can argue that a PR can abandon his PR status,
have his PR status revoked due to lack of residence, or get deported.
Actually this is perhaps what the USCIS think too otherwise why do they
give GC with expiration date on it? Remmeber in old days a GC was valid
forever

They are just plain dumb. For those who are waiting for their GC approval, they normally demand to see an EAD, even though the pending I-485 keeps them in legal status and they are not issuing the license until they verify the status with USCIS.

Worst yet is Texas where they didn't accept a US passport as proof of citizenship unless it showed USA for the place of birth (people complained and they changed that stupid rule).
 
My DL office gives DLs only to the date of the expired GC, so my GC and my DL expire the SAME day, I don't think they will renew it without me showing a valid GC or my citizenship....do they accept the I-551 on my passport for DL renewal?

Do I have to go to tha same DO office to get this stamp that my case is being processed? I have a closer USICS office in New Orleans that I can try going to for this stamp, I was fingerprinted there for my Citezenship Application back in Aug but my intreview had to be done in ATL.

yes, states must accept I-551 stamp. "I-551 stamp" and so-called plastic GC are equal documents (in fact, plastic GC is also I-551 document). I-551 is an official document, the state should accept it upto expiration date. Now having it on expired passport is another issue...as the others said, one should not get her/himself into this tide situation. Basically, having no valid identification soon...it is not a good thing when you are in middle of immigration application...overall it is not a good thing for day to day needs.

They make them expire so they can more easily push changes to newer more secure versions of the card over time. And make life more difficult for people with deportable crimes by refusing to renew the GC.

The bottomline is that I think the OP should just start passport and GC renewl process. Passport can be done in time. If citizenship come thru in time then just treat these as fun activities. But citizenship process can
drag on without your control. If you have already oath letter with oath date 10 days away, it is pathetic permisttic if you still think you need to renew GC or old passports. But since oath letter has not arrived, you have to treat
yoruself just as a PR not even a future citizen
 
I wish my country "CUBA" would give cubans expedite passports but that is NOT POSSIBLE for that country UGH! a cuban passport takes 4 months to get. So the only option here now is to apply for a renewal and try to get my GC or passport stamped. I already got my infopass so hopefully I can get thru this with the stamp at least until I get my Citizenship or my new green card. I DID what I was supposed to do, I applied for cititizenship before my 6 months but they took forever for the interview then they requested additional papers from me, so it is the never ending game, I thought by now I would of had a citizenship or at least an answer from them.

I just checked and indeed they changed their requirements concerning the US passports. Now they accept all US passports. Common sense finally arrived in Texas :D

If you have an expired passport, USCIS will give you a temp I-90 card with your picture on it along with your alien# and I-551 stamp good for 6-12 months.

When I got my PR stamp at my AOS interview my passport was also expired. The IO gave me this paper card and stamped my picture on it, my A#, and the I-551 stamp.

Go to CVS or Walgreens and get two passport pictures to bring to your info pass appointment. Its cheap at only $7.99 for two pictures as opposed to $290 for a new GC! But make sure you bring the 2 pictures with you...:)

I already have the two pics! I am going prepared and taking everything I could possibly take including a renewal GC form completed, the pictures, my expired passport, ALL my letters from my citizenship process and anything else I can find!

You don't need to renew you GC. Save the $300!! Thats what we have all been trying to tell you................:eek:
 
INDEED, NO NEED TO WASTE your MONEY/TIME AND USCIS RESOURCES, GET I-551 STAMP.

This assume citizenship will be achieved in time. But thinsg can drag go
on especially case of some crminal record as in the OP's case even if we judged that should not be a problem eventually.

If the DL depends on expiration date of GC /I-551, it really can put one into
a stressful and frstrating situation if you think about it.

If the OP doesn't get approved in time all he has to do is make an info pass and get another I-551 stamp for another 6 months! Sometimes they give temp 551 stamps for a yr....

To the OP. Don't donate $300 to the USCIS fund, it's NOT needed!!

well, that is a perspective, goal is to get US Citizenship. If the attempt is not successful and/or faces with major delay, OP can always extend and re-new I-551 & and also eventually apply for GC.

No need to apply for a replacement GC unless he is denied citizenship. He can keep receiving a 551 stamp!

Where is this official policy that one can get free I-551 stamp if teh filing is done before 6 month from expiration? Does the infopass desk even know this?

I am not sure why USCIS denies I-551 stamp, if LPR is in good standing and the OP explains his/her case (expiration proximity of GC card) and outstanding N-400 application.

At minimum, there is no harm for trying.
 
NO, I'm not paying for the renewal! but JUST IN CASE, Im taking the completed form, you never know with them. I won't mention anything about it until they say there is nothing else they can do. I'm assuming that the extention is the logical thing to do since I am covered because I applied before my 6 moths of my GC expiring. Let's hope I get a helpful person and this is solved.
