My dad pettition my brother?

My father is going to have his oaktaking for usc this jan 26. He wants to pettition my older brother who is 28 yrs old and unmarried. What do we need to file and about how long the waiting period?

Unless your brother was born in China or Mexico, the current wait time for his family prefrence category to become current is 5 years and 9 months.

You mean PHILIPPINES or MEXICO. ;)
 
the father should have filed a petition when he got his GC and shouldn't have waited till his citizenship. By the time he gets his citizenship, it would have been current.
 
Well, we are from the Philippines. What is the difference in wait times? Also my dad filed for him back in 2004 as a gc holder, should we just wait this out?

My dad wants to ask if there is a form we can submit to update his pettition last 2004 from immigrant pettition to citizen pettition. Is there such a thin and would it help?
 
I guess we shouldnt even try coz 2nd preference is now at march 2002? So my dads initial pettition will be ok in a few years?

actually, it's pretty much done automatically.

I did read about a memo recently that allows people to request that their category remain the same. Do look for it.
