Married was not accepted, case was denied

I have a friend who is from Jamaica, and he got married. They were not living together, but they were married, after the time come up, the INS contact them for the interview in Chicago IL, they separate each other and ask some question. The girl said she did for money and now they did not accepted (denied) the application, it happened like 5 months ago.

The INS told him to wait for the response, but he knows it was denied. He does not have the letter yet.

I will really appreciated if somebody give me some information to help my friend. I came to USA by employment and i know all the law about H1B and employment law, i got the residence by employment, not by family, then i can not help my friend. Any advice will be welcome or references.

well, if they denied the AOS, then the USCIS probably offered voluntary departure to the guy. If he wants to know for sure he needs to make an infopass appt and find out. He should be prepared for immediate deportation, though. He may also need a good lawyer, since all the advice we can give him on a forum is hypothetical.

Although it wasn't right to do it, why did the girl tell them that and completely ruin him?
 
He said, they made her a lot of questions and told her she can go to jail if she does not said the true. I believe she got scared and speak out. Any other option i can advice to him i will really appreciate, because i really does not know a lot about family case.
 
I am sorry about your friend and what happened. Is he and the young lady still together?

I really don't know a lot about a situation like that but many will respond to your question on this forum but you may not like all the answers you get because they will express their disdain about the legtimacy of this marriage and your friends intentions, so be prepared for that. Other than that it appears that he will have to leave the US or be illegal. I hope they don't ban him.

I can see you care about your friend but what she told them may have done him in. That is not saying that she wasn't supposed to tell the truth (always), because she was, but if they were not living together there needed to have been a valid reason (ex. school, job, etc.)

So he tried to get a Green Card through a fake marriage and got denied? Boo hoo and thanks for visiting the USA!

I would agree with dr_lha. I cannot endorse, help or even wish luck to someone who deliberately committed fraud to gain an immigration benefit. Sorry. Breaking the law is breaking the law, no matter how you slice it.

I honestly do not feel sorry in this or any similar situation... getting married for money makes the process MUCH harder for the honest folks who are married because they wan't to be married. I don't think you have to look too far past this forum where a bunch of good people are going thru hell when their situation is legitimate. Adjusting the status when you are off status(like me) is a benifit... getting married for money...forget the ethical part, it is against the law.
