Marriage to a US permanent Resident

A friend of mine is a US permanent resident. Just got married to a girl who is a British Citizen.

She initially came to the country on a visa waiver but her 90 days stay is coming up. My friend will be due for citizenship next year.

Because my friend has his business in America he wants to bring his wife here. I was wondering what would be the best course of action for these guys?

Any help would be appriciated.

there are two alternatives here:{1}he can wait till he becomes a citizen next year and file for her. They should be married by then. She will receive her GC under this arrangement within a year.{2} They can get married before her visa expires and he files for her.In this case, they can apply for adjustment of status for her.Under this arrangement, she'll be allowed to stay in the u.s but can't work until she obtains her greencard.Goodluck

Corrected for you.

There is not a legal way for him to stay in the USA.

Marrying and filing I-130 before the I-94W expires does not grant him any legal status.

She'll probably have to come and visit him here until he gets his USC. Even though he has the GC, his petition will not grant her a GC status in the near future. She'll have to wait until a visa becomes available; which will take years. Even if your friend becomes eligible to apply for naturalization, he will have to wait at best 6-9 months before he gets his oath ceremony. That if your friend meets all the requirements and is lucky to have his application processed without any complications.

His girlfriend could come and study here as an F-1 student or apply for an H1 visa. Unfortunately, there is no immediate solution to your friend's problem. There are many people like him in the same boat. Good thing she is a GB citizen and can come anytime she wants and stay for few months.
