Mandamus Action - Arlington Virginia

applied 2017 , filed mandamus jan 2024, status changed in feb 2024 to interview being sch, had interview april 2024 , got approved april , now waiting on GC. if u file mandamus spend time preparing , cos u are telling uscis i am ready.
Things were pretty normal before Nov 2024
I know couple of people who filed Mandamus last year and had similar experience like yours , In fact one of them got response within 2 weeks after filing mandamus
Post Nov 2024 is crazy , no directions , no clarity

Look at my case , they have not responded within 60 days and looks like they do not even care
 
Control what’s in your power which is to prepare so well you come out of the interview confident , let Uscis deal with their problem, they will respond soon , they have to ….

Turns out my attorney has totally disappeared,
Front desk office won't receive calls if i try to reach out to them, but if opt for "payment" , your call is received within seconds

Not sure way forward from here , its been more than 90 days now since mandamus was filed

What do you mean by the lawyer disappeared? I thought there was a lawyer, a paralegal, and someone else working on our cases. Are none of them reachable? Is no one in the entire law firm responding to your case? Who is your lawyer?

At this point, I think the lawyer who filed your case is the one you should ask for further information.

mandamus is a 2 way process and the lawsuit usually only proceeds after the ofiice director is unable to sch your interview using his discretion, also dont you have any receipt? Who paid government fees, that should have been your card while u pay the attny fees seperate.

A disastrous failure from attorney

I was finally able to get in touch with my attorney yesterday,

How did i make it happen ? Filed a complaint in Virginia State Bar, The state bar served him a notice and provided me a copy of it. My attorney immediately called me back

So what happened ? Why the delay ?

Lawyer "DID NOT" serve the summons issued by judge to USCIS, Yes, it is lawyer's responsibility to serve summons to USCIS and provide "Proof" to court

What was the excuse ? As per lawyer, he dropped the summons to his front desk to be mailed but somehow it did not go out and left under files ( I believe he is lying) , So he said he finally sent them out on March 5th , but i don't see any update on PACE / Federal court search portal

He tried to make it up and offered me free / pro-bono service for next step (Green Card / or if asylum is not approved then immigration court)

Let me share the name of that firm that literally wasted precious and most important time of my life,

I’m sorry to hear that. Fortunately, things are finally back to normal—thank goodness. I was worried about the effectiveness of mandamus……

I thought you were using Murray Osorio, but I might have been mistaken.

The attorney i was actually referred to, was at Murray Osorio and he was in process of moving to new firm

And he had successfully got my friend's interview scheduled from USCIS, So i followed him to new firm

So technically yes, i started with Murray Osorio
 
Update from today

The attorney sent out an official email to me taking responsibility at his end and offered to schedule my interview ASAP since he claimed to be in good relationship with government attorney, (Will see how that unfolds)

He further offered to take next step of Interview on him as pro-bono (free if we can say it)

If my interview outcome is granted asylum, he will take care of green card process as pro-bono , if outcome is immigration court removal proceedings, then he will take care of that as pro-bono (free)

Damage done, cannot undo the time so moving forward now

Many Lessons learned, and at mercy of extremely anti-immigrant Trump Administration Now

it’s not uncommon people waiting over 5 years to get their interview, I wait 8 years and this year got an interview. It’s totally random some people was interviewed with months some has to wait for years. I heard mandamus once but I didn’t pay attention, so I waited 8 fucking years. And I focused on making money and raising kids, I should have done mandamus during Biden’s administration lol. Now Mr. trump is screwing me twice.
