Disappointing experience on lawyer , he haven’t even started working

He was a completely different guy until he got advance paid by me

I will withdraw and find someone else if nothing happens this week

Sorry to hear that. If nothing changes, finding a more reliable lawyer sounds like the right move. Hope it works out for you.

I had a consultation with a lawyer who said a 3 year case has a 50/50 chance. So, I’m also disappointed and not sure if I should proceed with a mandamus at this point. It’s very frustrating.
 
Does anyone know who filed mandamus and had interview but it got defer to court? All i see in this forum most of them got approval after 8 years or so after filing mandamus.
 
I was given 3 possible outcomes for filing mandamus

1. USCIS will respond in 60 days (after receiving summons from court) scheduling an interview for me. The interview can be as soon as next day or next few months, which ever slot is available and work for USCIS. They do not take full 60 days to respond so they could come back any day within 60 days

2. USCIS will request for extension to respond (beyond 60 days) and will still schedule an interview

3. USCIS will decide to contest the case against me

1st outcome is the most favorable outcome as per lawyer. If interview is scheduled, then USCIS will then have 30 days to make a decision on my case (That's the condition lawyer has put in his mandamus filing, hence enforcing USCIS through court of law, not only to schedule an interview but also to decide within 30 days after interview, otherwise we will not withdraw)

USCIS has acted in a way before by scheduling interviews but then lingering on making decisions
 
You will be getting the interview soon, and it may happen at any time. You should start preparing for the interview now.

By the way, in a mandamus case, do we need to explain the harm caused by the long wait? Should we provide evidence of this to the lawyer?

Did you file it in a Virginia court? Can you share the name of the lawyer who helped you file?

You have to be honest with your lawyer the way you are with your doctor. Based on your input, lawyer prepares the case and files

The idea of Mandamus is the trauma / stress causing you because of delay , we all have our reasons ..... it can be financial hardship, health, unable to see family, any other reason bothering you, share it with lawyer and he will advise you if its worth ?

Oh, so you changed your lawyer at last? I had a consultation with them already and decided to wait for 4 years.
 
You are right … I was wondering same

Nada so far …. USCIS has technically 60 days to respond though

One thing I recently noticed is I started getting calls from random unknown numbers pretty much every day and there is no on other side … total silence

And it’s new number every time ( I am sure it has nothing to do it my case but then it never happened before … so just wondering )
 
Any word from the lawyer? As long as there is no objection from the government, that’s good.

If you’re getting random spam calls and texts, I bet your number got leaked somewhere.

I will ask him tomorrow,

I was hoping to get my case sorted before Trump takeover but it’s definitely not going to happen

By the way, is your lawyer Simon?

I understand. Even if Trump takes office, there won’t be immediate changes. Once your mandamus is approved, there will be good news soon.

I hope so … even though people like us are for real genuine legal and documented…. This guy is freaking everyone

Giving us anxiety for nothing
 
I am sure none of us (people discussing here) have been there yet , but any idea what happens when USCIS acts on our mandamus suit? like if they schedule an interview or responds back to lawyer etc

is there going to be an update on egov.uscis.gov or my.uscis.gov ?

like interview is schedule or XXX date etc
