Mandamus Action - Arlington Virginia

Nada

I am literally checking my USCIS portal twice a day to see if they scheduled an interview

Nothing so far

It’s been more than 50 days now since I filed my case

Let’s see

On the contrary … I noticed one thing … last week I renewed my Drivers license

It’s REAL ID compliant since day 1 ( been 4 years now ) and I renew it every year

But this time … my REAL ID was not approved

I am wondering what does it mean because REAL ID gets approved from department of homeland security

I believe they have to respond within 60 days, or they need to submit a request to extend the response time. Either way, there should be a reply within 60 days.

As for the Real ID, I renewed my driver's license at the end of November, and it's still a Real ID. Surprisingly, I got an 8-year validity. Not sure why you have to renew yours every year, isn't the expiration usually tied to the work permit date? Maybe it just depends on the state DMV?

Are already an Asylee?

That’s new

In Virginia , if you are a pending Asylee , you will get max 1 year for Real ID

For non real ID … you get what your EAD says

Are already an Asylee?
Approved asylee means a Legal Permanent Resident or a green card holder … that’s not a problem

But pending asylee and being in Virginia … you get max 1 year driving license if you want to go for Real ID

If not real ID then you get what your EAD says

Yes I understand that, my question is if you are pending or already asylee/green card holder

Pending. Sounds like different states have different rules. The DMV only checks the EAD and sets the expiration date based on the date on your EAD. Some people qualify for an 8-year validity, maybe based on age or the driver's license year. I'm not sure about it.

Your case was a confusion because pending asylum is always one year, that’s great

Today marks 60 days since i filed Mandamus, no response from USCIS

Spoke with attorney, he is checking and will let me know

Lawyer hasn’t responded yet … I tried reaching out to him twice

But I asked someone and I was told that Judge can actually sanction USCIS now for failing to respond within 60 days

How will this all benefit me ? Not sure … but let’s see

Hi, I have been waiting for my interview 3 years and 6 months. Currently my case is in LA asylum office. I was told LA asylum office is accepting only over 5-7 years waiting mark. I am thinking to file mandamus once I reach 4 years mark. Does anyone know what asylum offices don't fight back with 4 years waiting marks? Thanks all in advance!

Any updates?

Any updates?
My lawyer is completely disappeared

And I understand why , he may not have any answer since immigration/ USCIS is complete mess now
People being laid off , no direction , courts blocking presidential orders etc … it’s a chaos

But let’s see … I will share once I get an update …. So far it’s more than 70 days now

Focus on getting ready for your interview, it could come anytime , when i applied for mandamus in jan, i did not get a response till feb , interview was in april
Hi, did you file the mandamus in January 2025 and get your interview scheduled in February? What is the exact timeline? Which asylum office?

By the way, I'm still waiting to reach the 4 year mark before filing for mandamus. Abhatti filed the mandamus in December 2024, and it has been 70 days without any response.
