The Process: The memo outlines the new process and provisions to be followed by the officers, which also may aid corporate immigration counsel and employers in filing the applications.

"1. Initial Review Provision. All RIR applications must be reviewed based upon existing criteria for completeness of the application, demonstration of a pattern of recruitment, and compliance with applicable regulations such as absence of restrictie requirements, layoffs by the requesting employer that have not been adequately addressed, etc. Certifying officers at their discretion based upon information available to them, may deny the employer RIR request at this stage of review [Emphasis added]

- Applications not meeting current completeness/compliance requirements will be issued a Notice of Findings (NOF), as appropriate.

- For the remaining applications which have met the completeness/compliance review, the following guidelines shall be applied:

- Applications for positions requiring a Bachelor's Degree and three (3) or more years of experience or a Master's Degree [and] six (6) months of experience (assuming these requirements are appropriate) should be certified and not subject to the retest provisions noted below.

Re: RIR processing guidelines

I checked with my lawyer and he said that the DOL hasn't looked at Sprint cases in a long time. So, it will be a while before they review these guidelines and decide on how they want to process our case.

I am still hopeful that these guidelines will help moving our applications forward. Anybody else checked with their lawyers? I am keeping my fingers crossed for some good news soon.

New Year

I think Jan 2004 would be a good time for all of us. Last year, Jan seemed to be the time when the SESA movement took place. Maybe this time, it will be the DOL. Since the layoffs are over (at least for some time), they might start looking at cases and NOF's and get working on it.

If anyone hears anything in the next few weeks, please do post it here.

And the same to you! I called my lawyer the other day and there is just no action at all. Personally, I am going to get as many of my neighbors as possible to start calling our senators and congressmen!!

New person Assigned for Sprint cases.

I called my attorney last week and the attorney told me that the lady who was working on Sprint cases died sometimes back and now they hired some one else for sprint cases and the new person is getting training. We don't know when the new person will start working on Sprint Cases.
 
Oh man - thats just lovely!! My fear is that I'LL die before my case is processed!!

Status checking using phone

Hi,

Has anyone tried to check the status using the phone with INS?
I guess it is not working properly. The system doesn't seem to pick up the right case number. Has anyone noticed this?

DOL AVM system

You are right if you are talking about the DOL Automated Voice system. It's been like that since this Monday.
 
I just noticed - I believe it was under the Chicago link - the number of an actual person in Chicago.

In his case, his regional LC was received in early Sept. 2002 and he was just told that he received final LC approval Dec.29th 2003.

I was received in Chicago Sept 23rd 2002, so hopefully this is a good sign, although I will not be calling them directly - we have been asked by our lawyers not to.

Then there is the class action lawsuit filed by this great site!!!

Hope is on the horizon!!

Do you know if that person was with Sprint or just another company? I know for sure that people working for other companies are getting approved in Chicago DOL. So, I was just curious.

I just checked the Chicago DOL thread and that case was filed in Michigan in Sept 2002, forwarded to Chicago DOL in Sept 2003 and approved on 29th Dec 2003, and it's not a Sprint case.
 
what conditions?

Hopefully things are turning better for us at Sprint! But, I wonder under what conditions that Michigan case was under? If it's same as our (previous layoff record problem) then we can expect some activity in our cases too!

DOL Chicago Automated sysyem

Hi! Roy or anyone, I would appreciate if someone could tell me how to check my Labor Application's status through the automated system.

To be more specific, what is the toll or toll free number, what option to select, and how do I find out what my tracking number is? I received something from the Kansas City office that they forwarded my case to DOL Chicago, but had no such number, which I could claim as a tracking number. Any help would be appreciated.

Contacting senator

Has anyone started the effort of contacting the Senator? If not, would the folks on this forum be interested in starting an effort to do so? It's been too long, we have to know soon whether this process will end or not.
