LC through Sprint

Now..I'm having a doubt if Sprint will ever support our applications! Can we trust Sprint with this anymore?

If we can't get LC cleared before Nov or Dec, by then there probably will be another round of layoff, we will have little hope to get LC even if we survive the change.
 
Did anybody talk to their attorney yet to get more details. I wrote to mine, but haven't heard anything at all. I am worried :(

Guys,

I work for Sprint and my RIR app has been sitting with the Chicago DOL for quite a while. I am seriously considering applying through someone else for LC with all the uncertainity here. Anyone else considering something similar?

Unless you change job, in another word, you change your employer (H1B sponsor), otherwise how can you get payroll in the new company? Without a payroll, it is difficult to get GC in current time, am I right?

In theory, you can do the entire GC process without an H1. In practice however, it is possible to start LC (state and fed) in parallel without H1, and once the LC process is done, do the H1 transfer and get on the payroll of the other company.
 
Also, my LC has been with DOL since April. From the posts on this forum however, I have seen some folks whose LC has been pending since Sept 2002, and that's what is worrying me..
 
I can't seem to get any info, but I have been pending at Chicago since Sept 2002. I'm pretty sure what has happened is that it has been changed from RIR to non-RIR.

Someone correct me if I am wrong.

I notice the RIR dates are now 6/03 (in which case I would have been approved by now), and the non-RIR date is 7/02.

Does anyone know how long the date for non-RIR has been sitting at 7/02? Is this moving at all?

I appreciate your input.

May be i am wrong, i always had doubt about this is done.

If they designate your case as NON-RIR, doesn't it come back to State(KS)?. I think NON-RIR Dates at chicago come into picture once you clear State lC again (in NON-RIR category)
KS dates for RIR is July'03 for and April2001 for NON-RIR.

Does any one working for sprint, heard their case is remanded to state?
 
I don't think any case is remanded to KS state. All the cases are on hold at DOL Chicago and someone posted that DOL Chicago is going start working on Sprint cases in August. August is almost over and I haven't seen anything happening.
 
Even if the cases were remanded to the state, our attorney(s) would have been notified, which does not seem to be the case.
It just looks like our cases are "frozen indefinitely", like most other big tech firms who are laying off people left and right.

You are absolutely right. Does that mean we have to wait indefinitely?

Let's assume the company doesn't have lay off for 6 continuous months in the near future, how much chances can our LC be approved by state DOL then? I am trying to figure out that percentage of possibility.

I am wondering whether those people in other big companies, such as Lucent, Mot, etc, who had similiar problems, finally get their LC/GC or not, and how soon. If you know such a case, please post so that we can estimate our future result.
 
As far as I know, this phenomenon has been going on for almost a year, and most people that I know in companies outside Sprint are still in limbo, waiting for their LCs to clear. I think what happens is that the DOL freezes the apps for a while, and just when it is ready to reopen the cases, more layoffs occur, and the cycle repeats itself.

I don't want to bring all our hopes down, but I suspect that a similar situation will happen to us as well. Don't know the best way to resolve it, but that's reality at this point.

FYI folks, I spoke to my attorney today, they told me that so far they have not received any Sprint labor approvals for over 6+ months. However, they said that they have also not received any denials or NOFs. Basically they are just saying "wait and watch".

how long!?!

Is this happening to employees in other big companies that have layed off IT resources recently or is it just with Sprint?

Actually DOL Chicago is lot better compared to other regions. In San Francisco DOL, they are simply denying RIRs from big companies that have laid off people and asking the companies file the cases for regular non-RIR processing. Chicago has not done that so far. They are taking long time in approving cases, but they haven't denied any LC filed by Sprint yet. Hopefully, it continues .......
