Latest I-94 not returned during travel out of USA

My wife's H4 expired in Aug 2002. She had extension approval March 2004. She travelled to India on May 22nd 2003. WHile going out of USA at JFK airport New York, Air India official took only the old I-94 (The one which she got while entring the country) which expired. The official did not ask or look at the new I-94 which is attached to the H4 Extension (797 form).

Will it cause any problem during reentry? Do we need to take any action? Please let me know

----- She did a mistake she should have given both the I-94 at the time of departure from US, if she submitted only expired then her record will show that she over stayed her I-94 and can create problems in future, you should get her latest I-94 and can deposit with the JFK or talk to attorney what has to be done because it can be issue in future

My guess is that since she extended her status in US, she would have got a new I-94 that has the same I-94 number as the old one. If the old one was returned, then BCIS will have a departure record based on the I-94 number which they can link to the new validity period. I don' think there will be any problem.

This happens sometimes.
Sometimes the airlines loses the i94. So dont worry.

Submit all the i94 when she leave next time.
 
Simple Fact: When you extend a visa the new I94 will bear the same number as the old one. All border inspector need to do is get the I94 so that they can track your movement in and out of US. No need to panic.
When she comes in back into US she will need to fill a new I94 form. That is all.
When the I94 check (mentioned in murthy's link) is done by whoever is doing it, they will easily find that there was another I94 with a new expiry date with the same number which was issued by BCIS .
They might also come to the conclusion that the airline official screwed up.

Ginnu: That post warns about people who simply overstay their I94. Suresh can easily show that the H4 extension was approved with a new I94 (even if that I94 was lost) if questioned. Got to keep the cool when this question pops up at the POE.

I do not think there is any problem with that.
Here is what happened with me. I filed for the extension of H1, and the I94 # on the extension does not match with the last I94 card which I git when I last entered US. I called her and asked what should I do, and also what I94 should I submitt while leaving the country. According to her you should never submitt the I94 one attached to the I797, always submitt the one you received when you entered, since the one attached to I797 is for record
