Labor Processing Times in California Due to 245i Part6

Sent to DOL 9/4/02

After the amendment letter to EDD, my case was sent up to DOL in SF on 9/5/02. I wondered whether that means I can pass DOL and get the LC. My amendment letter to EDD was a long rebate letter regarding my prevailing wage. If EDD let me pass, does that mean DOL will let me pass?

Hi pm2002,

How long did SESA take to transfer your case to DOL after you provided the additional information?

SESA had requested some additional information in my case and my company has just sent it to them - I'm trying to get an idea of how much longer it is going to take for them to transmit it to DOL.

For me, I needed to amend the salary offer of the job due to prevailing wage requirement. The whole process took about 1 months.

6/4/02 SESA sent out letter ask to amend salary requirement to meet prevailing wage.

a couple of days to receive letter in the mail.

a couple of days for lawyer to prepare document and mail to me

Sign the document and post the ad with ameded salary inside the company for 2 full weeks

sent back document to lawyer for them to mail back to SESA

my case received at DOL on 7/5/02

so i am about 1 month behind comparing to other people with same PD of 8/13/02

How long?

I waited for exactly one month after sent out the letter to EDD. My case is similar to Turbo's. Need to amend salary and 2 more wks company job posting. RIR EB2.

I just checked the site and didn't find any infor that you are approved for LC from DOL. Not yet? Still waiting? Oh My.....
 
DOL go by receipt date

DOL processing go by DOL receipt date. as for me, the receipt date is 7/5/02. For you i guess is 9/5/02 or something. DOL SF now is processing cases with receipt dates at DOL of 12/2001. So it will be long while....:( And in regards to your question about DOL letting you pass the LC, is very hard to say. All the cases that are processing at DOL were all passed and transferred from EDD, and there are cases that were remanded back to state/employer. So we have to look at the time when they process our cases, and also depends on the officer too. Officers are giving some guidelines but i think when it comes down to approving or not is all subject. So let's hope for the best. Good luck.

Hi Everybody,

As I mentioned in my previous posts my case got a query from SESA asking for additional recruitment details for the 6months period before Sep '20 - 2001 when my case was filed.

Looks like the company has only info regarding job posting on compnay web-site .

Attorney is also under doubt whether that information will be sufficient to satisfy the EDD officer.

The following otptions are left for me.

1) send the information what we have and see if it goes thru. If it goes thru fine otherwise it will go to non-RIR.

2) withdraw and apply in RIR after enough advertisement after 6m or so.

Will Appreciate your ideas ASAP before attorney replies to the query.

If it is non-RIR , how long its going to take to get clearance from SESA and DOL?

If it was me I would send SESA information I currently have and hope it satisfies the EDD officer, worst case scenario it goes Non-RIR, but the application will still preserve its PD.
SESA is currently processing April 01 Non-RIR cases, thus you only have a few more months. By withdrawing and refilling you are looking at 6 months + the average of 11months it is taking for RIR cases, Thus about 17-18 more months.
Obiviously you want to consult your Lawyer and take the appropriate decision

Thanks for your suggestion.

In worst case if it goes to Non-RIR at SESA there is a difference of 5-6 months as now non-RIR is at Apr 2001 but the issue is at DOL a year difference ( RIR Dec 2001 and non-RIR Dec 2000) which is lot !!! which worries me...

Don't get caught with 'SESA processing April 2001 for non-RIR'

Its NOT a few months difference. They take months to process a single day in April 2001 (S245i deadlines.....). I can almost bet that its going to take them atleast another year to finish with April 2001 for Non-RIR. And I can also bet that DOL will also take a lot more time than advertised. So if you are switching to regular processing, be prepared to wait another 2-3 years for labor.

PD Jan 2002

My six of H1 limit is going to expire in Sep-2003.
My PD at SESA-CA is in Jan-2002. Will I be able to get the labor cleared before my H1 expires. I have been trying to all the math possible and changing it everyday based on that day's updates. But, to say the least, I am confused on the outcome, rather the timing of the outcome.

Please, can someone put this in perspective for me.

Try This...

Try talking to your lawyer about the PERM... See what his/her thoughts are on it.

As per Logicators post, SESA is processing Oct 12, 2001.
Your PD is Nov 17, 2001.
So it will be about one more month before SESA gets to your case.

Hi ,

As promised, I am updating my latest status.Today i came to know that my lawyer has recd a notice. SESA has asked them to amend the salary offer .

Now I need your help, what do I need to do ? or what does this querry means. Has anyone ever recd. such notice, if Yes , can you help me to understand this.
