Hi everyone!
Im a newbie here at immigration portal. I am here in the US on an L-1 visa and am working and residing in California. My husband on the other hand moved to Chicago a few months ago because he was offered a job there. We got married in December 2006. We havent filed any documents with USCIS yet but i already want to resign from my work (the Company that sponsored my L1 visa) and move to Chicago so i can be with him. My questions are:

1) Would i be out of status if i do that?
2) Will my resignation from the Company that sponsored my visa affect his filing of petition for me?
3) Can i apply for work authorization even if my visa is stamped L1 and exclusive for the company i am working for right now?

Please help

Yes. If you want to stay in status at all times, then you apply for adjustment of status (AOS, or GC) first, and then you resign.
2) Will my resignation from the Company that sponsored my visa affect his filing of petition for me?

no

if you are not planning to work for your company, but would like to work for some other company, you should apply for a work permit. If you do not plan to work while waiting for your GC, then you don't have to.

Thanks so much!

That's sad..so it means i wont be able to resign until we file my papers. That will take long coz i wont be able to go back to Chicago until June 2007 coz of my work. By then my I-94 is almost expired (Nov 07 expiration) and i already miss my husband :(

I dont' understand why you won't file I-485 as well as I-130 etc tomorrow ?

Wouldnt the filing take long coz of the many requirements we need to put together?
it may take some time for you to collect information, supporting doc or so, but filing is quick.

That's the thing, it will be hard for us to put together the requirements coz my husband and I are both working in different states.
What if we file my papers after the effectivity of my resignation? Would it really be a big deal with USCIS that i am out of status when i filed it?

You don't need to live together to collect all the docs. My husband and I live more than 700 miles away. I used 1 week to collect the info (mainly waiting on medical forms). You can do it.

Did you put different addresses in the forms that you submitted to USCIS? Does that mean that we can put different addresses in the I-130 form? Wouldn’t that be a problem with USCIS (living separately, I mean)?
