Folks,

Quick Qs: After getting their GC, do parents have to stay in the US for atleast six months in a year and every year to keep the GC alive??

Is it possible to keep the GC alive by staying in India and visiting US every now and then?

Thanks

A green card is not a border crossing document but for people to reside permanently in the USA atleast until they get citizenship. If your parents just want to visit occasionally get them a long term multiple entry visa it is alot cheaper than green card.

what do you mean by "keep the GC alive"? if your parents are not going make US their "Permanent Residence" then whats the point of obtaining the GC in the first place?

You can obtain re-entry permits for them. The first time you apply uscis grants them for two years (that means they can stay up to two years outside usa). But the subsequent times, uscis will only issue for year or so. Make sure you apply the re-entry permit when they are inside USA.

Do not stay outside the U.S for more than 5 months.

If you need to stay for extended period then apply for a travel permit.

A GC is for living and working in the US. They must pay taxes on world wide income. They should expect to carry health insurance 12 minths a year - if they can get it - due to preexisting condition limitations.

The real question is, why did such parents even bother with getting a GC? It is a costly and tiring prcoess. Why go through it if it really is not needed?

They can visit once every year and keep their GC alive, but that will probably help only for a few years. After 4-5 years of doing that, they will probably be caught in POE by suspicions that they don't actually live in the U.S and "deported" (unless they have a very good reason for staying in india for 5 years).
In general, I agree that its stupid to apply for a GC if you don't want to actually live in the U.S. It is way more expensive and dangerous than issuing an entry visa.
