Need some opinions here...

As you see(in my signature) something appears to be stuck in the system for us.

It appears that everyone in my time frame or people that have filed AFTER me have already received updates and interview letters.

Is it time for an infopass or should I wait a little longer?

You know what's funny?

I did that.. and it says they are processing applications with a date of April 28th.. or something like that. So, just for the heck of it.. I try about 5 other random offices to see what they are.. and they all say the SAME thing!

Furthermore, I checked some of the DO offices where people on this board have had the process work smoothly and it says the same thing.

So those dates really don't mean anything to me.

Well, they may not mean anything to you - but they do to USCIS. If your DO's date hasn't passed your receipt date, USCIS will simply tell you to wait a while longer.

You should be grateful - my interview took two years to schedule, after waiting a year simply to have it picked up. If they hadn't forced an interview on the case, I'd be filing my N-400 now.

I waited 6 years and still waiting on I-485 which based on the Employment...Spent lots of $$ for lawyer, Renewing my EAD, AP...etc. I finally gave up and filled another one based on my marriage to USC and to amazing i got an interview letter within a month. But at one point i am just like you, but never gave up....just hang in there and you will get your interview letter and your GC soon

Cheers

shas,

I am in the same boat. my EB i-485 has been pending for 5 years now, so I filed marriage based this July. Hopefully it will go faster. Once you get the GC through marriage, should you withdraw your EB petition or do anything with it? If so, how do you go about it? I was just thinking, if I don't withdraw it, they will deny it based on the fact that I don't need it. and it just doesn't sound good for future applications to say you had a petition denied... maybe I am overthinking this whole thing... :) Anyway, please share your thoughts.

They'll deny the EB case if the IR I-485 gets approved. And yes, you're overthinking things - USCIS cannot arbitrarily deny an approvable case just because a prior petition get rejected.

nati309, you can have both the applications simultaneously but as soon as one is approved withdraw the other one, if you don't CIS will deny it anyways. I don't think it will cause any harm when you apply for a citizenship.

Good luck

thanks, everyone! How do I withdraw it if not during the interview in person (say, they can't approve my case because my name check is pending (what happened to me at my EB interview), so when they do, it's not in person)? Do I schedule an infopass... do I send a letter? please advise what's the best way. thanks again!
