Is it possible to apply asylum after one year deadline

Dear all,
Is it possible to apply US asylum after 4 years of overstaying because of threat to dire consequences from home millitants for not assisting them with money.Going back home is something unthinkable threat to kill is there.And the demand letters and threatening remarks are there too.The Government there is inactive.Civilians,armies,millitants are killed here and there.Millitants are more dangerous than armies.They can knock out anyone whenever they feel to do.Government is not reliable at all.

You can apply for political asylum anytime, The fact is The will not approve it. in other words, you will be interview as another applicant with an IO, but he will not have the power or jurisdiction to approve it. The only one who has that power is the immigration judge. Of course in that case you have to proof that you deserve the asylum status plus you have to justify the reason Why it take you so long to file the application. So, it will be hard, but not impossible, get a good lawyer and many proofs of persecution in your home country that shows that you are in danger overthere, in other words that IF they deport you, you will not survive overthere...
Good luck in your case. I know that people who deserve that status will get it. It seems you are one of those..

yes its possible , i know someone was granted asylum by the IJ after 7 years of overstaying his visa , you need a good lawyer who can put your case together ,good luck

I was granted asylum by the Immigration Judge after being out of status for 10 years. The one year rule is something they will dwell on. You have to prove that in the last one year things have changed for the worse which increases your chance of being persecuted. I recommend you go to www.uscis.gov and read about asylum. I went to court without a lawyer and this website information was very helpful to me.

I too was granted asylum by IJ after more than 6 years of overstaying my visa.it's very difficult but doable.you have to have a very strong case,lots of supporting evidence and a good lawer.good luck!
 
Yes it is possible. It it in your best interest to have an attorney to help you navigate this process. You need to meet one of two conditions: (1) there have been recent changes in country conditions such that you have new fears of persecution or (2) there were compelling reasons which caused you to file late.

Even if they will not excuse your late filing you can still get withholding of removal which will allow you to work here. So please see an attorney ASAP.

Thanks for all your replies.One more thing.What will be the case if I come from an X country through India, getting fake passport from India? And then being here in US and after making ID with passport presenting to be an Indian, the agent asked me to sent back the passport to him.He told me he can arrange for my families also.I trust him and I sent back to him.Now nothing is heard and his whereabouts is not known.
How will it be if I tell in the asylum interview exactly like this?Even if I hire a lawyer, will they detain me because I cannot give them the Indian Passport through which I come from along with the I-94 that was attached with the passport.But I have the National Identity Card of my real country.
So, the main doubt is what will be the case if I cannot present the passport I come through?Looking forward to your replies dear friends!

See an attorney. This is too complicated to discuss in a public forum.
