Hello all,

I am a greencard holder and I am going to apply for citizenship in 3 months. Right now I planning to go to my home country and get married. Is it good to wait until I get citizenship to get married or is it okay to marry while I am a green card holder...does it affect the GC visa processing time of my wife anyways....Can I file her for GC once I marry her eventhough I am in GC status and change status to uscitizen when I get my citizenship.....does it affect in anyways if I do like this...will it take only the same time as it takes for a normal citizen??...

I have actually one more issue where I have gone out of US for more than 1year and when I checked USCIS website they says, if I go more than 1 year, i can file for citizenship after 4 yrs and 1 day...Is this correct or is there any rules associated with this...actually I came to US and went back to my home country after one month of arrival, for finishing my studies...

Sorry for the long message...but just explaining my whole situation .....plzzzzzzzzzzzzzzz helpppp......I was searching online for weeks now and got frustrated and I found this community with lots of related questions...hope to get atleast some replies.........any help will be much much appreciated....

When you marry isn't so important. What matters is when you file the petition. You can marry with a green card and file the petition, and then upgrade the petition later when you become a citizen.

How long were you gone, and when did you return to the US after that long absence?

Marry and file in order to speed things up a bit. You merely "upgrade" the petition from F2A to IR (immediate relative of a USC) after you naturalize.

See 8 CFR 316.5(c)(1)(ii) for your residence situation. You add 4 yrs and 1 day to the return date from the last LONG trip.

Thanks a lot for your valuable information - Jack and Joe.

I came to us for the first time in april 06 and went back to india in may 06 (it was about 1month), and returned back in June 07 (almost 1yr and 2months). Can I file my citizenship in June 2011 , when it will be 4 years and 1 day after my return of the long trip. It will be a total of 5years and 2 months after I entered US the first time but had 1yr and 2 months outside...

I was planning to get married this may 2011 and then file her petition when I am a GC itself and then file my citizenship in June 2011 and when I get citizenship, I will upgrade her status ....and it will take teh same time as it would take for a US Citizen to file his wife...Is this sounds correct..or am I missing something....

Once again thank you for all your help..awaiting your reply.

Thanks
Nidhin

Hi Joe,

Marry and file , ...you mean like marry and file her immediately evenif I am in GC status (before I apply for citizenship) correct?.

Thanks
