immigration officer got my Green Card and Passport!!! please help me

Hello guys

I am 58 years old and I went outside of USA for 6 years . I came back 3 month ago in LAX airport and the officer in airport known that I was 6 years out of USA and got my Green card + Passport (my own country). they gave me an temporary ID card (Arrival Record) that has my A number and expire on 14 may 2009 . I went to the court last month but I had not any translator or lawyer and they postponed it (next session of court) on November 2009.

Now I have to come back to my country as soon as possible and I it is not important for me to get my green card , but I need my passport that I can come back to my country. how can I get my passport. please help me because I have a serous problem. also I have not any job or insurance or enough money to stay more in USA.

Go to your embassy and see if they can help you get a pass for one trip, just to back home.

Unless you are a suspected criminal and the US needs to stop you from fleeing, I don't think they have a right to hold your non-US passport. Call your country's consulate, they can probably urge the US govt to release your passport or at least advise you about what you should do.

Also call up CBP and explain that you want to surrender your green card status and leave the country, but you need them to return your passport.
 
they got my passport . I can not go back to my country because i have no any passport.
Ask your country's consulate about options for returning without the passport. For example, US consulates have a provision to grant a Transportation Letter to citizens and permanent residents who have lost their US passport or green card when overseas, and the letter will allow for a one-time entry to the US. Maybe your country has a similar provision ... if you know your passport number and have some other ID, you may be able to get such a letter or a temporary travel document from them.

Every one with more than one year continuous absence from US without permit or SB1 visa knows for sure that his card is not valid and for sure before he travel back to US many will tell him; your card is a piece of crab and despite that he/she insist to use it. It may work few times, like any illegal act, but in most cases this will not work and the consequences for that are not that good.

Go to the same LAX airport and ask for the CBP deferred inspection office. Explain to them that officer on date XYZ has kept your GC and your Passport and show them temporary ID card the officer gave you with A # on it. Inform the officer that you want your Passport as you want to travel back to your home country. Inform them as the embassy of your country in US cannot issue you new passport as your passport has not been stolen or lost. ( you can inform then that it not important for you to get your green card and if they need any form to fill then fill the form)

** if you have not done any crime in US then they cant keep your passport.

Holding passport is to ensure you will leave the country.

My impression is that you are now not legal to stay in the US, but with sort of reason for a short period, going to court, for example. You passport will be returned to you at the POE on your departure. Go to the same LAX airport and ask for the CBP deferred inspection office if this is the case. I am positive that is it. You will be able to go back to your home country.
