I485/GC problem ?

Hi,

My I-140 has been approved a year ago. I-485 filed almost a year ago.

I got my EAD and working on EAD. I didn't file my AC21 and I don't intend to file AC21. I am doing "same or similar" job as in my labor or I-140.


Will I face any problem getting my GC ?.

Please advise me.

-------------------if USCIS asks then you have to file. you will need permanent job offer letter with same/similar job duties from new employer

As I don't intend to file AC21, will USCIS reject my I-485 based on my previous employer (i.e GC sponsored employer) notification to USCIS ?

If USCIS asks me to submit the permanent employment letter for the same/similar job, I can do it. Will USCIS reject my I-485 without asking me ?

USCIS should give you a Notice of Intent to Deny if your previous employer cancels the original I-140. You have 30 days to respond with eligibility under AC21.

I have changed from employer A ( GC sponsor) to B. Now on EAD. 6 months passed for I-485 and I-140. Doing same/similar job.

Sending ACT21 will not harm as long as your job is similar or same. I would say that will give you a peace of mind you have done as per the rule. Not sending ACT21 may not be cause for your I485 rejection. Currently u r covered under ACT21 and you can alway send it later on even if there is problem as long as you have job.
