I140 Approved & Waiting on I485

Hi all,

I got my I140 approved on 12/20/04 and I am still waiting on my I485 approval.

If there anybody who waited or waiting on their I485 after I140 approval. Please post here with details. Let us know how long was the wait.

According to the recent posts here, 485 approvals are mostly taking anywhere between a day and two weeks.
 
Since the retrogresion coming in to effect on January 1st 2005. What if our I485 did not get approved by that time. What effect the retrogression will have on our I485 processing?

Retrogression effects are being discussed in different thread(s). I came to know that a co-employee had his GC approved last month. His 485 got cleared a week after 140 clearance.

Did you get your I485 approval.

It is already more than a week since I got my I140 approval, still I don't see any update on my I485.

I am sorry to be asking this again..Is the PD the day the labor application was filed with the state agency or the day the labor application was sent to the dept. of labor? can anyone clarify this for me..thanks

Date of receipt of labor certification application with state labor department!

I485

My I140 was approved on Dec. 13 and I got an RFE on my I485 on Dec. 17. Have not heard from my attorney yet on what this RFE all about? I'm hoping she's not on a long vacation.

Did you try to call your attorney's office? Would she not have an assistant? Please don't wait till they call you!

Thanks for the clarification. We are suspecting that my lawyer might have filed our case as EB3 and not as EB2 as we had understood. We dont have the I140 receipt with us so dont have a way to confirm. Our I140 is approved, but not the I485. By this, then our Priority date would be October 2001 becasue that is when we filed our labor at state. So, will the 485 cases with PD before Jan,1, 2002 be processed immediately bec. they dont cross the date? Is that what they mean?
Please clarify if possible.
Thanks again for your help and please understand our panic bec. of this sudden change in our situation.
 
RFE on 485

Talked to my attorney this morning and she told me that RFE is about proof of legal status since I came in the US. She will be sending today the same documents that were included when she first submitted the application. For now, I'll just wait and see how TSC will handle my case.

The murthy link talks about concurrent filing, not concurrent adjudication. These are two different things. Jdr's PD is before the retrogression date so his 485 will not be held up, however if TSC resorts to non-concurrent adjudication than Jdr effectively has to wait till the 485 processing dates cross his filing date before he can see any action on his 485.
 
Does this mean that if it non-concurrent adjudication, since my 485 filing date is 02/05/04 and the current 485 processing is sometime in July 2002, i will have to wait until my date reaches it even though my PD is current..Not sure if that is what it says..
Because, this is what my lawyer says:
"Since your priority date is 10/18/2001 you can still get
your I-140/485 approved even after the EB3 priority date retrogression to
1/1/2002 in January."
 
True, will_get_there, but the concern jdr had was the effect of his PD on his case with reference to retrogression. My intention was to tell jdr that he had nothing to worry about his case because of retrogression. The link I sent had further links with some useful clarifications. I don't think concurrent adjudication was the point.
 
Thanks guys for all your input. i know it is hard to take a guess with USCIS but what would you guess the timeframe to be for 485 approval in my case? Is it going to be another 2 yrs then?

looks like we have missed the bus by a week. Because my frnd got 140 just one week ahead of me that is 10th. Got both approved with in a day or so. Hmm we are finished.
