Here's my story. My girlfriend came to the US in 1996 with her at the time boyfriend, they got married here. They applied for greencards together. They got a legal seperation in 1999, and still have not recieved GC. Their status is Alien Resident "refugee".

I have been with her for 5 years now and want to marry her. We went to a lawyer and they said that it would cost about $3500. Im a working class hero and dont want to spend any money that I dont have, so here I am asking for instructions on what to do. If someone could please give me deatiled instructions on what steps I should take, I would be eternally greatful. And please dont tell me to use Google, ive tried and cant fnd anyone with this same situation.

Thankyou,
Eric

I know she has to get divorced but I was asking for steps to take.

I.E. withdraw application for GC with her huasband or get divorce first ?

I don't know what you want to know.
you didn't provide enough info, like who you are(US citizen, LPR, non-immigrant etc) and which of she or her husband is primary applicant in asylum claim, what stage she is in etc.

Ask in asylum section.

I am a US citizen born and raised, her husband is primary applicant, and they are alien residents at the moment

If you are US citizen let her go through the divorce process then you can petition for her after you guys get married. its shouldnt be that complicated. I dont think she has to withdraw anything. just guessing here haahaah. You know what man, dont hire a lawyer, its a waste of money. Once she gets divorced and you marry her, then file papers for her. USCIS woudl then advice you at that point if you are doing things right or not. Chances are that your case would thenbe faster, and they might trash her other application. Just do it.

one of us is confused because just above you said:

They got a legal seperation in 1999, and still have not recieved GC.
so, do they or do they not have a GC? if they do have a GC, that means that they are legal permanent alien residents.

What status is the girl in? if you can't answer our questions correctly, we can't give you meaningful answers.

She is still "married", they are separated legally.

Their status is "refugee"
