I had my interview this morning but...?

Hello everyone! I've been an avid reader of the different threads here, and usually don't post much.

My USC husband and I went for an interview this morning at 9:15am. We arrived at 9am, and went through the metal detector etc. We were barely seated at 9:05am, when we were called 5 minutes later.

The officer was very nice, but so hard to read. I could not tell if he was serious or joking. Before we sat down, he made us take an oath that we would tell the truth.

He then told us he had reviewed our case while having coffee this morning, and that he is familiar with everything we had sent in.

His first question was why I had not filed for my son? I explained that it was because he lives with my parents in South Korea and that they have legal guardianship over him, while we cannot afford to have him live with us yet.

He asked us other questions such as how we met, what our first date was like, etc. He also asked us why we got married in Vegas! When we told him convenience, and that we were going to buy a house together, he seemed satisfied. We also showed him pictures of our later BIG wedding and he seemed appeased.

He asked to see additional documents we wanted to provide: birth certificate for myself, hubby and my child. He also asked to see passports. He commented on how many countries I've been, asked how many languages I speak, etc. He looked at our wedding pictures, and old pictures of us since we started dating.

He made copies of the documents, and kept two pictures. He disappeared saying he would have his supervisor look at it, since I was out of status for more than 180 days. He came back saying his supervisor signed off on it. *Note, he did not use the word approved. However he did say we would receive the green card in the mail within the next three weeks*

He then told us the IMPORTANCE of filing for the removal conditions within 90 days of expiration. He told us he has seen so many people forget, and regret it later. He made us sign a paper saying we understand the 90 day window for removal of conditions.

He did not take my EAD or my AP. He said the EAD will automatically expire once green card is ordered for production. He also said to keep the AP. He did not stamp my passport either.

He asked if we had any questions, and I asked whether it is safe now to buy tickets to leave country for Christmas vacay. He said he thinks it would be safer to wait for actual green card to arrive.

He also said that their system is down due to a glitch and might not be up till this afternoon or tomorrow. He said "this is why I can't approve you right now, because I have to wait till the system gets back up. But once it is back up, I will order the card for production".

He said I would receive a letter in the mail also explaining the 90 day period to file for removal of conditions, and that I would receive a 757 in the mail (or is it 797? can't remember!)

He said I had my AP, just in case I really want to travel.

SO NOW, my question is, would it be safe to buy tickets for our vacation once I get that email saying the card has been ordered for production??? It is only 11/29 today, and we are planning on flying 12/22.

Also, does this seem like a positive outcome interview? Was my GC really approved? So hard to celebrate when I don't have a stamp on my passport!

Well to me it seems like a good interview and I think you will be or are already approved, here are the weak points of your interview and would have put me in doubt if i was the IO.

You said;

If you can't afford to get the child to live with you as yet then, How come you had a wedding in Las Vegas? And after that while you can't seem to afford to have a child to live with you you still went ahead and had a BIG WEDDING on top of that, and here is the kicker, you are asking him you are ready to travel again in the busy and expensive holiday travel season?
All of these DO NOT fit the bill of people having financial woes and cannot have thier own child to live with them because of that.
You should thank your stars that i was not your IO (LOL) otherwise i would have given you a very tough time at the interview.
 
You asked about the stamp, I have been seeing more and more people recently reporting on this forum about no stamp at the end of the interview, it makes me think that maybe since the GC gets produced and mailed within couple of weeks these days that they have stopped putting the stamp or atleast use it when its absolutely necessary, we will see what the others report here before saying something for sure about no stamp.
 
namecheckvictim, you are absolutely right about the financial situation sending mixed messages. Maybe I should have said that my father (who is the legal guardian of my son, paying for all his expenses) paid for the big wedding, and we are also travelling on his Delta Miles this Christmas! :)

You have nothing to worry about in my view, if you were going to be denied, the IO couldn't have even bothered to talk to you about removing conditions.
 
I saw the same red flags and more. This father or probably, stepfather, didn't file an I-130 for his stepson? I am not looking at a strong family unit here? Is that really your son or is it your little brother or nephew? Are you trying to build a paper record of a "son" for later immigration? Wedding pictures from Vegas, did you actually know anyone in them? Vegas is the U.S. equivalent of New Delhi or Saigon, where you can rent a wedding reception including guests. You can buy a house but you can't afford your son to live with you?

If I were the Officer, I would make lots of notes for the I-751 Interviewer to grill you on later. I'd lull you into a false sense of security and let you make a bunch more mistakes. If I were the suspicious type, that is. USCIS gets two bites at this apple. On the other hand, you may be on the up and up and will prove any suspicions to be unfounded misunderstandings over the next one year and nine months of wedded bliss.

I just am so impatient and want to reserve those tickets now, but don't want to do it till the card is in production. Or at least till I get the welcome letter
 
When exactly did you cross the 180 day out-of-status period? Before or after you applied for AOS?


He disappeared saying he would have his supervisor look at it, since I was out of status for more than 180 days.

Hi Triplecitizen,

I was out of status before I applied for the green card. He explained that was the only hurdle in our application, so he had to make sure his supervisor was okay with it. When he came back, he said "you are good. my supervisor signed off on it." He then proceeded to tell us we would get the welcome letter in the mail first, and after 2 - 3 weeks we would get the green card.

Is it safe to assume I have been approved?
 
He did say however, that he would rather I wait till I get the physical green card in the mail. He said that even though they approve the green card, if I don't have it physically with me, it is up to the immigration officer at the airport to allow or deny entry. He said it takes only 3 weeks, and is best to wait.

But plane seats are booking up fast...

I am thinking once I get the welcome letter, should I go ahead and book?

i hope you will get your GC soon but to be honest with you verbal acceptance does not mean alot. Just keep an eye on the case status i hope it will soon change to card production soon. Have you signed up for the email notification or not?
 
Hi Faddu630, yes I signed up for email notification. The IO said "I will approve it today or tomorrow, depending on when the system comes back up."

Fingers crossed. I'm getting impatient!

Due to your overstay of 180+ days, the AP will be useless if you leave the US before your GC is approved.

Once you get the official approval notice on paper, you know you're approved, and you'd be able to leave the US and reenter with the AP if you haven't received the physical GC yet. Or you can take the paper notice and use it to get an I-551 stamp in your passport if you show evidence of upcoming travel. So I would say go ahead and book the ticket once you have the paper approval notice.

Question, is the approval notice the same as the welcome letter? Does USCIS send out an email/text alert saying they have dispatched a welcome letter/notice of approval? Also, how long does this usually take fro interview date?

Yes, USCIS will send you a notice of approval via email or sms, provided you registered for the service. You will be fine, just wait for your approval notice to be mailed. I would advise you to book any travel, before you have USCIS mail on hand, because what is the mail is lost or misplaced? USCIS has 30 days to mail you the card once you are approved for green card status.

They wouldn't have given it to you anyway. The approval has to be finalized before they can give you the I-551 stamp, and he couldn't finalize the approval due to the system being down.
 
I hate how crazy this is driving me. :) I set up an Infopass appointment for December 9, just in case I do not get any Notice of Approval text message/email. Maybe then I can ask if I can get a stamp? Has anyone had this situation before?

I remeber the IO saying "HOw would you like your name to appear on the green card?"

But still, I will NOT rest until I get my approval notice! :)
