I am H1-B, girl-friend pregnant, illegal -- please help???

Hi everyone:

I've been here in this country for 3 year on H-1B visa. Worked all the time, paid taxes, no offences or brushes with law. My girlfeind who came here on short-term travelers visa overstayed her visit for almost a year. Now we learned that she is pregnant. We want to keep the baby.

Now my question -- any help would be greatly appreciated. Someone told us that if baby is born in US he/she becomes US citizen automatically. Is this true in our case too? Also if she gives birth here, what would happen with her and me as parents? Any ramifications, if anyone knows?

I believe even though she stays in the US illegally, the baby will be US citizen. But US citizen baby does not do anything to his/her parents' status in the US unless baby is older than 21 years old.
Your GF has a serious problem since she overstays in the US nearly a year.
Overstay in the US more than 180 days to 1 year will end up in 3 years entry ban, overstay more than a year will be 10 years entry ban.

I'm not sure, but hospital may not even ask her status.

------- Baby delivery in hospital is not a problem, If she is does not covered by insurance then check with the hospital in advance what are the charges for normal delivery, or C-section
