I-94 question

Hi all,

I spent nearly an hour searching the archives to see if my question was already answered. Doesn't look like this was addressed. So, here i go......

I recently moved from company A to company B. The company B has filed for a premium processing for the H1B transfer. The attorney called me today and said that he has filed the petition as a POE petition. What it means is that i won't get a fresh I-94 alongwith the approval notice. Hence i will have to go out of the country and return to get a valid I-94.

I stay very close (couple of hours drive) to the Canadian border.

Can i drive across the border and back to get the I-94? Is the process any different that what i would have done if i were flying to canada? I have absolutely no clue on who or how old I-94 will be collected and new I-94 will be issued at the border while driving. If anybody have any experiences, please fill in. Appreciate the info. Thanks.
 
I think your attorney applied for a new H1 (not a transfer), Why do he do that?

If you do not have h1 visa stamped in your PP, you need to get visa stamped in your pp out side US before re entering .

----------- did you ask what does it mean? as other poster has said I think your lawyer filed it as NEW H1B petition and you will not get I-94 attached with H1 approval notice.
What it means is that i won't get a fresh I-94 alongwith the approval notice.
-------------- why did he do that?? were you not on valid H1 status? he was supposed to file H1 with request of I-94 attached with H1 Tranfer approval. go to the lawyer and ask for the expanation.

hello everyboby ..I have some doubts...please give me some suggestions

Till now I am on H4 and got approved for H1b (on Aug 2006) WITHOUT I-94
So what should i do :confused: .
My H4 would be expired on Jan 2007
Does any body face this type of problem..

was it Change of status from H4 to H1?
what is your H1 employer or lawyer saying? have you asked the lawyer?
* if it was new H1 then you need to go out get H1 visa stamp and then enter on H1 status get I-94 with H1 status and then work (if employer has job)
Many file H4 to H1 COS and dont find job
 
You can work on H1 b visa, but you need to travel outside US. Then get it stamped in the native country and then enter on H1 status get I-94 with H1 status and then you can work with your employer.
