Jim Mills, thanks for taking the time to reply. I understand the scenerio exactly. That was not the reason for me to post the message.

I am sure there are many people like me, some of them already have a decision on their case. I just want to get feedback from them.

Hi Gopats,Jim Mills,

I\'m in a similar situation where my lawyer applied before my PD got current, when i realized what i happened i did check with the IIO as to what i should do, she said chances for rejection were slim but considering my concern she checked with an higher official if I was going to be ok. She did say that i should not have a problem. A couple days later my lawyer also called to confirm this and was told the same thing. My question is : What are the chances of getting rejected after what we\'ve been told by the IIO, do they have any say in the approvals??? Can we fight the case on these grounds if god forbid we get a rejection. Please advice

I request all of you to please update any developments. I shall do the same.

Another news I learned today is that IIO told me I shall have a decision on my case within 30 days. Does that mean my case is already assigned to an officer?

Yes i\'m the same as hope99, i lost my password and was unable to login so i had to use a new screen name, sorry about the confusion. In anycase, the info u shared was indeed very helpful, i hope and pray that we don\'t have a problem, i\'ve been checking AVM very regularly but haven\'t heard the golden words yet. I plan on calling an IIO one of these days too, to see what she has to say.

Called IIO this morning

Called IIO this morning and she said it would be a couple more months before i hear anything back on my case. I asked if my case was assigned to an officer and she said we can not release that info as it gives the applicant an unrealistic time frame for a decision to be made, it did not make sense to me but oh well, i guess i\'ll just have to wait a lil more. Well, if any of u folks get any updates please keep me in the loop.

I had a similar case.
Mine had reached INS 1 day late,
(2 years ago, when the PD retrogressed, 1 April 2000)
(on 31st march 2000, PD was current, From 1st April 2000,
dates became non-current).
INS processed my application and rejecetd after 2 years.
You must know that, INS operates very mechanically.
I consulted excellent lawyers, who suggested that
refiling is the only way.
I have refiled it, & have finished FP.
(The most amazing part is, I have not received
receipt notice after refiling, so I donot even
have a new LIN number).
