I-140 Tracker CSC (Please maintain format)

Congratulations Hello_AM.

Thats good news. Two of the guys from our tracker list here have gotten approvals recently. Thats good. I got an rfe on feb 14th and my rfe response was recd at csc on 19th of march also. Gives me a lot of hope.

You said you got rfe on feb 14th. When did you respond to rfe? I got mine on feb 24 and response reached them on mar 19? My rfe was pretty much same as yours...regular pay stubs, ability to pay kinda stuff. Just trying to get a rough idea of how long it took for ur case after rfe was responded to.

I got the response back in 12 days time [ including the sat/sun ]. Got the approval in mail two days after the online status change.

Thanks askgc, for your help on this issue from the beginning.

The document has lots of company specific information, so I may not be able to post it here. Anyway the content of the document is not important, the connection that we explain for each and every company specific tasks with 5 years of progressive experience is that makes the difference I guess. The document explained each and every tasks that I do at my firm needs progressive experience in the similar field.

As per the RFE, this document has to be notarized with the signature of somebody who is technically knowledgeable to make this kind of judgment. I did that with the help of my manager.

RFE on I765 - 02/09/2004 (RFE for additional signatures for me and spouse.. Probably the signatures were not clear for card printing)
Reply for RFE sent and recieved on - 03/10/2004
EAD( I-765) Approved - 03/27/2004
Letter of FP has arrived today. Scheduled for 04/16/2004

Did you receive Fingerprint requests for you and your spouse or just for you? The reason I am asking is I got it only for me and not for my spouse. Thank you.

MY spouse's FP notice arrived two days later than mine at my current address, INS also sent FP notice to my lawyer.:) My suggestion is checking with your lawyer or just waiting a few more days.
 
pay stubs etc

if i get an RFE for pay stubs etc, do I need to submit paystubs for all of 2003 or last 12 or something like that?

i couldn't find some of my paystubs, but 'paid to date' reflects the right amount. would that suffice?

Approved I140 but never filed I485

Friends,

I had an approved I140 from my previous employer. This was back in April 2000.
THey never filed for my I485 since I got laid off.

I checked with the company attorney and my I140 is still not revoked.

Can I file my I485 using the employment letter of the current employer.

I am stuck at the Labor Certification with current employer for the past 30 months.

Hi,

My 140 just got filed recently and I have a question. In may case my previous experience does not fully match with my current work. In the sense I was doing hardware maintenance in India but I am doing hardware design here. My exp letter talks about hardware knowledge only but not about design. Will there be an issue ? Do they strictly expect the experience to be the same as what we do, here, now ?

I dont think it should be a big issue. But my advice to you would be to get an additional experience letter stating some general stuff that would cover hardware design so that you can show it in case of a RFE and remember you can get that from ur colleagues too .
This is just my suggestion and I might be totally wrong

I think you can file I485 bit i dont think you can file using ur current employers EVL .because u are not eligible for AC21. i would say talk to ur previous employer and try to work something out. also many people have suggested that one can file 485 without the EVL too. so i think u have some options here .u could file the 485 without the evl and not let anyone know. then later u could send them EVL. i mean there are lots of options....
but frankly speaking i did not have the guts to fle 485 without the evl with my current employer....
so suggestions are many but u need to evaluate all the risks etc.


again i dont have any legal knowledge so please use these comments at ur own risk

"Concurrent Filing," 90-day I-140/I-485 "Concurrent Adjudication"

Hey, Step Aside "Concurrent Filing," 90-day I-140/I-485 "Concurrent Adjudication" is Looming Up!

According to the AILA, the USCIS is launching two interesting pilot programs to complete adjudication of I-485 applications within 90 days of filing.

In family-based I-485 cases, Dallas Local District of USCIS will launch such program beginning from May 3, 2004. The I-485 applicant will be "interviewed at the time of filing" and adjudicated within 90days. FB-485, DV-485, Special Immigrants-485 will be covered, but Asylee/Refugee-485, EB-485, and LIFE Act-485 will not be covered. Wow, the families and DV lottery winners should move to Dallas! It is hoped that people in Dallas USCIS jurisdiction are not exploded with flock of married couples, the relatives of U.S. citizen, etc.
In Employment-based I-140/I-485 cases, California Service Center is reportedly about to launch such 90-day concurrent I-140/I-485 adjudication program for EB-2 concurrent-filing cases. NIW-based EB-2 will not be covered by the pilot progam. Remember that the eligible cases are non-NIW EB-2 cases of concurrent filing of I-140/I-485 only. In EB-2, if you file NIW case, you are out. If you file I-140 for non-NIW EB-2 but not concurrently with I-485, you are out too. Only currently filed cases will be covered by this 90-day I-485 adjudication pilot program. Since the concurrent-filing rule requires that the I-140/I-485 be filed at the jurisdiction of I-140 petition, meaning the job site or place of employment, the people who obtained a labor certification approval for the job sites outside of the California Service Center jurisdiction should not attempt to flock into the California Service Center by selling their homes in other jurisdictions and moving into the CSC jurisdiction. It ain't going to work! Interesting question which has yet to be answered by the California Service Center is "undetermined location" labor certification cases. These cases are filed not at the location of job or place of employment but the location of the main business office of the employer. Accordingly, should employer's main office be located in the California Service Center jurisdiction, no matter where the roving job will be located, such EB-2 filers are allowed to file at the California Service Center regardless of their job sites and location of residence, and theoretically, they should be eligible for such pilot program privilege. It Ain't Interesting?
What do they mean by "pilot program?" Common sense tells that it means a testing of certain program to test the water. Overall, pilot program will give a hope to all the I-485 filers, including family-based and employment-based, in that eventually, it will reduce the I-485 processing times tremendously throughout the country. Apparently, it is targetting at achieving reduction of processing times at one year across the board in the near future. Since it will include the time for I-140 and I-485 together, it ain't bad at all! Hold your breath!!!!!!!!
