140 RFE received, hopeless.

just got a RFE from USCIS, they pointed out that it is a problem my LC was filed in 2002, whie I got my master's degree in 2003 since my LC requires a mater's degree. I told my lawyer when i joined my company i only finished all the course work nad didn't officially graduate till later. and he said it was OK, now what? cant imagine let go of my 2002 LC.

I applied for my I-140 on May 01, 2006 at the NSC on EB-2. My first LUD was on 07/22/06. After that nothing happened. I then initiated a Service Inquiry with the NSC on Dec. 05, 2006 (after 30 days past six months regular processing time period) and waited for 45 days. Even then nothing happened. So, finally I upgraded my case to Priority Processing on 02/02/07. My lawyer sent the paper-work on 02/05/07. There was a LUD on 02/07/07 at 7:30 am in the morning and my I received four e-mails from CRIS at 6:30 pm in the evening, that my case was aproved and approval notice was sent. Now my lawyer says that if my money order crossed the dates on which my application was processed, then there is a possibility that I can get my $1000 back. Anyhow, I am relieved that I got passed this step and waiting to launch the next Big struggle for the I-485. See you all guys in the I- 485 forum.

my case is exactly like yours ..... it was filed 5/5/06.....only one LUD 7/22 and then no LUD at all ..... I inititated the query and its been about 3 weeks so i will wait another 4 weeks before i do any thing else


It sounds like they just want $1k and they are just sitting on cases on purpose....they are showing dates of June,July,06 for processing but have cases pending from May,06

RFE: Timeframe to reach Attorney

Can anyone tell how long it takes for RFE to reach Attorney office from the date when it is issued by USCIS, for My I-140 Premium Processing RFE was sent on 02/09/07 (As per online message)

My I-140 has been approved yesterday after 7 months.
Just last night I sent mail to my attorney for upgrade to PP, but morning I saw this approval. God save me $1000 bucks.....
And another thing without RFE too. If anyone waiting since long time be patience some more time, that could be helpful for you.

What kind of company do you work for? Is it a big well known company?

Received I 140 approval

Hi Everyone

I have received I 140 approval copy from my attorney today. I have been following this forum since last 7 months and I really appreciate the efforts put forward by participants in terms of exchanging information.

Good luck to everyone and see you all in 485 thread (once the date becomes current :))

Information regarding my case:

EB3 RIR Labor ETA Case (PBEC)# P04321-05652X PD: November 19 2002 (Too bad was not in EB2)
Labor approved: May 22 2006
I 140 filing date: June 29 2006 (NSC: LIN-06-202-5204X)
I 140 approval date: January 31 2007
 
Received mail from CRIS on 02/15/07 about requesting for additional evidence.Mail does not indicate what they need. I will keep you guys updated when I receive more information. How long does it take to receive the information? What are the possible scenarios of getting RFE?
