Does anyone know how long it will take to get approval for the I-140 if we request a duplicate LC ?

Thanks for your insight :)

140 RD 05/16/06
LUD 7/22/06

Still no update. Since mine is out of the processing date,
lawyer has opened a service request, keeping my fingers
& toes crossed....

Is anybody in similar situation?

Still Waiting...

Yes, me too. I am in a similar situation. Applied I-140 EB-2 on may 01, 2006 at NSC. LUD: 07/22/06. No movement after that. Opened a service request on Dec. 05, 2006. No reply after 45 days and no change in LUD. Running out of options. Thinking of upgrading to PP towards the end of the month.

Hi there, i noticed that your receipt dates are identical as mine! I however only had one FP, what are code 1 and code 2? right now the processing dates for 140 and 485 at NSC are both 7/13, you think our 140 will delay 485? or they will be approved separately? thanks and lets keep each other informed.

Code 1 FP is the ten fingers which is used for the FBI check. Code 2 is your signature, index finger and photo which is used to create the actual plastic green card. I'm not certain if everyone gets a code 2 as you submit a photo and signature with your application and they have your finger print from the code 1. Some people get a code 3 which is both code 1 and code 2. In theory we should get our cases looked at by now.

Can you please give us more details about the RFE..thanks

RFE is about Education Evaluation. I have over 9 Yrs experience and I did my part-time MS in Software Engineering after my BS in Technology.

My MS was sponsored by my company though a very reputed Institute (BITS) back in India.

They wanted an education evaluation for that .

The thing that was strange is, my current company did my education evaluation when I was sponsored for H1 and submitted the same for 140 application.

My lawyer said, it is better to respond with what ever they ask for , rather than argue with them, further delaying the process.

Hence they did it with other agency and it was approved.

RFE for ability to Pay

Hi All,

I have got RFE for ability to pay. Can someone who has already faced same RFE guide me how to respond to the RFE.

I am on my 9th yr H1 , now I have RFE , can I change employer and start my GC again and get my 140 approved before my H1b expires?? Is this possible..

Let me know Thanks...

Should go for Preimum or not

My EAD is approved, FP is done and received treavel documents today. To my understanding they will process I-485 regardless of I-40. or i should go for Premium now.
