Hi Vali,
I was tracking few I-140 cases and still there are few pending since March 30'2006. So, don't know the reason why you mention that case of 04/03/2006 would be approved or getting approval soon? Actually I am in a kind of fix situation. My visa is getting expired in next 3 weeks (completed 6 years), and if my I-140 does not get approved in next 3 weeks then I need to pack and go. My employer is asking me now to go out of country and come back in 10-12 days to get more time..
Please advice. Thanks

my situation is exactly like yours. If we go out for 10-12 days,I know we can re-capture those days. But my question is this whole re-capture process will take it's own processing time and if the re-capture is not aproved before expiry date on I-94, can we stay inside US after the I-94 expiry date? I mean counting on re-capture days can we stay here for those many days?
Anybody has gone thr' this re-capture? How does it work?

i was checking various i140 cases on apr 03 2006 and most of them look either approved or rfe with in last two weeks .so i was just curious. thanks anyway

since your labor is approved and I140 pending, I guess you guys can easily get 1 yr ext. on H1-B.
 
Hi Pururwa, since the labor was not filed before the 6th year started, so I believe(as per the lawyer) we need Labor and I-140 approved to get 3 year extension. One year extension is applicable only for those whose labor is file by 5th year before starting the 6th year. Do you have any link or documnet if there is any chance to get 1 year extension if Labor is approved and I-140 is pending? Thanks in advance
 
Got RFE, Any Idea how long does it take to receive the hard copy?

I received USCIS e-mail saying RFE has been issued On August 11. Guys any idea how long does it take for the Lawyers to receive it.

My 140 has been approved on Aug 11th 2006. I have 11 years experience with 3 year Bachelors + 1 year PGD from India.

My RFE was about ability to pay and they asked for my last 5 years W2’s and company's tax returns.

LC PD: May 02, EB2
I-140 FD: Apr 5, 06
I-140 RD: Apr 10, 06
RFE issued on July 19, 06. Responded Aug 9, 06
I-140 AD: Aug 11, 06

tyrant, the spreadsheet is the one that is passed around in this thread. See page 81 in this thread, I think that has an attachment.

MI - EB3, PD: 11/18/03
I140 RD:04/13/06
I 140 LUD: 7/22/06, 8/16/06
I140 Approved : 8/16/06

My lawyer sent the following things
• Company’s tax returns for last 3 years
• My w2's since I joined this company
• Last 2 pay stubs of mine (even though USCIS didn't asked for this)

REF issued yesterday

i recieved email from USCIS yesterday stating that Ref was issued yesterday. is it possible to call Nebraska and find out what is Ref is about.
