Is your I-140 PP?, b'coz my I-140 filled with NSC on 11th May 2006, no LUD after 7/22, just curious to know .

No It is not PP. We didnt upgrade to PP. I suspect you should hear from them this month or early next month

Finally a relief

Today I received an e-mail from USCIS that my I-140 has been approved. Finally a sigh of relief. Thanks for all your support and see you in I-485 forum.

so EB2 are getting approved from June,06 and EB3 cases are still pending from April/May . Always strange !!!

Update on my RFE.

My lawyer got another evaluation that didn't help. So the approach is:
to argue that the AEC reflects BS or equivalent and that "equivalent" refers to any combination of coursework that equates to a BS degree. It will be up to CIS to determine if this is acceptable, but I think we are in a good position to make that argument since it does not say "equivalent degree", just "equivalent".

Is there anyone who can confirm this will work? Or should I insist on getting another evaluation equating my foreign degree?

NSC..RFE..Ability to pay... pls help

Dear Gurus,
I received the RFE from NSC today. It is about employers ability to pay.

"Pls submit evidence that the company has ability to pay the offered wage from the labor date. also submit 2005 tax returns"

What do suggest that we should submit along with this for the smooth approval. I am being paid less than the offered wage, so i guess sending in w2's and paystubs would be problem?

Pls suggest!

Why would you want to send your W2 and paystub to show company's ability to pay? I'd guess it will require submitting company financials, past, current and future contracts etc.

my PD is Sep 02, the PD as of November 06 is Aug 02

my I-140 is Aug 06 and the current processing date for NSC is May 06.. NSC is really slow on processing.. i doubt that it will approve 2 to 3 months or ahead of my PD..

it is advisable to re-apply my I-140 thru premium processing???

it is true that I-140 will be no more backlog within 6 months??

You don't need to re-apply..you just send in your $1000 bucks and they put your application to the front of the line. Having said that, I think that when your PD is current, you can file your I485 concurrently without having your I140 approved (can someone verify this). As such, there is no advantage at this time to go to PP as your I485 will take much longer any which way and you'll end up with your green card at the same time.
 
IT looks like there is no use of just fighting on retrogression alone you have to raise the voice against FBI Name check delays which is also taking 1 - 3 years.


Issues:
a) Labor BEC - 3 years
b) I 140 - 2 weeks to 1 year
c) Retrogression - Typically will stop you and you might have to wait for 6 months to 3 years
d) New thing - FBI Name check (under 485) is taking around 1 - 3 years

My co-worker saud, concurrent filing if the LC approved and the PD is current, you can file I-140 and I-485 at the same time. Since my case not like that, i'm not sure my I-140 will be approved 2-3 months from now thats when my PD will be current and i could file I-1485. Any idea about this?

You can file 485 the day your PD is current, provided an I-140 is filed or is being concurrently filed.

Anyway, one more question, what do you mean by "concurrently filed" and/or concurrent filing??

Concurrent filing once the LC was approved and PD is current, you can file I-140 AND I-485 at the same time. Is this correct?

I have eb-2 RD 06-13-06 and ND 06-27-06 they are processing 05-16-06 I ma not sure is this RD or ND. ist is worth going for PP? or shall I wait?

If you filed 140 and 485 then that would be treated as one packet. If you did not file them together, I-485 will be treated as a separate application. I had a friend whose 485 was approved even before 140 was approved. 485 can be apporved if 140 is approvable.
