Is I-140 petition more important than I-485 petition?

Voting Yes for a petetion to improve I140 than I485. Because guys can be off the company hook six months after or as soon as the I40 is approved ( if 485 was already pending for 180 days).

I don't know how much will it help in filing a petition, but I would say it's no harm in trying. My vote is yes.

Voting on this forum does'nt matter in any way, as BCIS does'nt really pull up its socks if people on this forum are upset with their processing delays.

We should all focus on petition for I-485.

Unless USCIS clears I-485, there is no use of fighting for 140. Basically we will be sitting in another queue even if 140 gets approved. It is going to benefit only those who are planning to use AC21.

wouldnt u agree though that 140 is more important? without 140, 485 processing is meaningless.

Why would BCIS not consider I140 petition but consider 485 petition? Both are filed with BCIS.

I agree with compudada. I-485 can't be touched unless I-140 gets cleared. I-140 is very crucial/important stage as compared to I-485, bcos using I-140's approval and AC-21 one can switch jobs and be independent. There is no point thinking about I-485 without I-140 approval.

I also agree that 140 is more critical. It gives flexibility to change and join such organizations who can support 485 better than the one who filed for labor. And it also gives flexibility to slap back on face of certain employers who try to take advantage of the fact that 140 is pending.
I summary, 140 provides more options for 485 approval.

Well we all know and agree that with AC21, it is crucial to have 140 cleared and have spent 6 months after filing 485.

12 - 18 months delays in 140 is making us loose the chance of using AC21, and making a whole molery of the AC21/concurrent filing option provided to us.

Ideally, either 140 should clear in 6 months or AC21 should be extended to pending I-140 too.

No one is denying the fact “140 is important for EB-GC” but if we start 10 petitions at the same time, it’s not going to help. I-485 petition is already out there and generated a lot of attention.

Let’s get I-485 done first and then focus on I-140.

I do not understand why you want people to focus on 485 when they dont even have 140 cleared. It's like telling a high school student to focus on college education.

Even if you have your 140 cleared, you should support 140 petition for benefit of other immigrants. If not, then you should just hang out in 485 forum.

This is the height of selfishness.

Because USCIS cares a dawm for all the petitions we file.
 
I don't understand why some people who have already got their 140's approved are trying to sabotage this petition. Well there's no doubt 485's need to be approved faster, but there's no denying the fact that the 140's need to be approved faster too as it allows people to use the ACT21 portability, if anyone without 140 approved get's laid off which is common place now, they are in deep shit. It is very important to get past the 6 month period with 140 approved to be safe. I support this petition wholeheartedly!! It's the effort that brings result, there's no point being negative and foolhardy all the time.

Whether this petition works or not, only time will tell, but there's no point just sitting and doing nothing. If someone's doing something good, appreciate that and support that instead of pulling them down.

First I –140 is not the property of employer. Labor belongs to him. He gives you the labor. It has co-ownership. It as much as belongs to employer it belongs to employee also.

Let us be fair here.
I-140 stage plays a crucial role in while using AC-21. So it is important.

My I-140 took one year three months for approval. It was almost year after I was laid off. If people are worried about their I-140 they have right to ask CIS to process their case fast. It is not fair to ask them to stop for any reason. Even if your I-485 is late by month or two it is OK. You are not going to loose much. But I-140 can be revoked at any time before its approval. I have seen such cases first hand.

I have gone under such a tension. I know the pain. Do not give the suggestion of waiting as you have passed that stage.

Its a great idea that we are coming together to send a petition to BCIS/INS. Unless we do something like this, our papers will be lying in Vermont while illegal immigrants from all kinds of countries will get their Greencard.

Just because we are white collar workers doesnt mean we shouldnt take a leaf out of trade union/blue collar tactics.

Great idea guys

Let's implement it ASAP and send the petition to the guys in Vermont.
