I-140 CALIFORNIA EB2 Tracker only

Please help me prepare to file I-140/I-485

Hi guys,
I recently got my LC certified after a long wait and now i am getting ready to file for I-140/I-485.

I have few questions, hope you gurus can provde some input.

1. My labor is certified from a different state than where i am/had been working (CA). Company corporate office is also in CA. I-140 for both these are supposed to be filed at same address in CA. Can this LC certification from a different state cause any problem in I-140/I-485?

2. The required qualification and experiene mentioned in LC application was Bachelors with 5 to 10 years of comprehensive experience. I was going through the threads and find that the experience should be
(a) post baccalaureate: If i count my experience post and before joining current employer then it falls fews(20) days short!!! I have been working with this employer for more than 4 years now. Will it be a issue if i file in EB2 category? Or will it be a issue if i file in EB3 now since the LC requirement was similar to EB2.
(b) mention of "progressive experience" in LC application: There was no mention of "progressive experience" on my LC application, instead it was "comprehensive experience". Anybody had any problem in EB2 category for missing the word "progressive" ? (EB2 guys with Bachelors + 5years and not masters degree)

I'll appreciate your comments very much. I just want to make sure i don't goof up. These questions are worrying me.

Finally the online case status of my I140 says approved.

I485 was filled concurrently in december'03 not sure what is the status?? need find the receipt number for I485!!!

I called the number. They mentioned my Finger prints results were send on 04/06/2004. Any idea how we can get the status updated by INS as it still says Notice for finger prints was mailed to you in march'04.

Good Luck on your applications...looks like they are being processed.....hope you get your approvals soon.....please continue to post the scanned results for sometime even after getting your approvals....

Receive copy of 485 approval notice

EB2 concurrent ND: 10/16/2003
Just recieved the copy of 485 approval notice, can't believe it is true, the online status still says "received fingerprint result ...", and I didn't recieve any info on 140, online status for 140 says "received"

Also no news on spouse's 485, online status still says "fingerprint notice was mailed ..." does that mean he needs to redo fingerprint? but we didn't get any notice on a 2nd fingerprint

PhDChemist, since your LUD gets changed to 09/24/2004, mine gets changed to 09/24/2004 for both 140 and 485, and the approval notice says ND 09/23/2004, maybe you will get your notice soon.

Got approval letters yesterday in post mail.
Neither recd. any USCIS e-mail nor any LUD update yet.
Just got directly approval letters... Great!!!

EXP: 6 years at the time of filing
Original Labor: MS or BS plus 5 years of experience.

Direct approvals no RFEe, no emails, no LUD update

No, only 485s I got in post mail.
Got email from Attorney too, she got everything.
140 is for employer not for employee.

How much time it takes to receive an RFE for 140? Our lawyer did not receive the RFE from USCIS even after 11 days.

140/485 processing time

Hello All,

I just got my LC and I am about to apply for 140 and 485. I have a master and the attorney filed the case with RIR/EB2.

Can any one give me an estimate of current processing times?

If I apply for the 140/485 concurrently by the end of this month, when can I expect things to happen?

1 week -> Receipt Notices
1-2 months -> Fingerprint notices
2 months -> EAD/AP approval if not in pilot program
3 months -> Approval or RFE if pilot program picks up your case
1 years -> I-140 approval, maybe I-485 approval if you're lucky
2 years -> I-485 approval

As with BCIS, there's no such thing as a timeline, things can vary wildly.

Do they pick cases in pilot program randumly?
If the pilot kiks in my case, in 3 months what do they approve? 140/485 or both?

There's another thread for approvals via pilot, just search for "pilot" in thread title. if you look at it, you may get some idea. If you get approved via pilot, 140 and 485 get approved, provided there's no problems.

I140 OR EB1 approved

Hi all,

I just got e-mail from my lawyer that my I140 got approved. LUD for my case got changed on 9/24/03 but no change in status, also when I called the 800 number to check about the case they told me that its being processed and that they can not send an official inquiry yet. I know this is the forum for EB2 cases but there were so many helpful discussions here I just want to keep you posted and thank the forum croud for the support. Details of my case:

EB1 OR non concurrent 140
RD: Sep 24, 2003
ND: Sep 26, 2003
LUD: was 9/26/03 for a year and changed to 9/24/04- no status change
EDU: PhD from US State University
EXP: 3 years after the degree

Will I485 RFE or approval notice be mailed to home or lawyer?

Does anybody know where I485 correspondence will be mailed to by CIS - do they go to lawyer address or my home address? I recently moved home address. And my I140 approval notice went to lawyer directly. Thanks.
 
EAD and Advance Parole

Hello All,

I just spoke to my attorney and they he is talking about EAD and advance parole.

Here is my status as of right now.

My H1-B is valid until April 2006. My wife is on H4 and both of us have visa stamping on our passports until April 2006.

Just got the LC approved and about to apply for 140 and 485 concurrently.

My attorney is suggesting that I need to apply for EAD for my wife only and he wants me to stay on H1, so that I can travel overseas with my valid H1 and my wife may work on EAD and she can as well travel on H4.

What should I do? Should I apply for EAD or wait for the whole GC process is completed?

Any suggestions please!

I got our (mine and spouse) approval e-mail for 140 and 485
both today from USCIS after 3 year + wait.

485 - RD 11/17/2003, EAD, AP approved before no RFE.
AD 10/05/2004.

Waiting for the postal mail. Hope you guys get yor approvals soon.
