Non concurrent case still waiting

Filed on 9/25/03 EB2

Inquired on 10/7. Got an response to get back to the attorney in 30 days.

I had a conf. call with him on 10/15. Decided to regroup again on 11/15. We may have response from Immigration around 11/7 (30 days after 10/7).

I didn't have any RFE.

Hi,

I may be in a similar situation JYEJC.. My papers were filed semi concurrent

EB2 - I-140 - RD 09/08/2003, I-485 RD- 10/02/2003.

My lawyer called the national customer service center and they replied as your case has been pulled and is pending.
So the question is Did you call or your attorney called the customer service center? and we did and inquiry on 10/8/2004.
 
My attorney

had called CSC on 10/7. I am still planning to go CP.
The response from CSC was that they need 30 days to respond. My attorney will call them again on 11/7, if CSC desn't respond till then.
 
I-140 Approved!

Please see the dates in my signature. I work for a public company with ~250 employees. Revenue>100m/yr. I have a MS degree from a well known US school and previous experience from a well known US company. No 140 RFE.

Still waiting for details on my 485 RFE though.
 
JIT dates

Any idea about which JIT dates apply for concurrent processing? I see that there is about a 2 month difference in the last published JIT dates for EB2.

I hope so, but I do not think so.

The speed is slow down since last three published JIT.
It would be little less than one month.

Hope I'm wrong. at least I could have a call to CSC.
 
I-140 and I-485 approved

Got email confirmation from USCIS today that my I-140 and I-485 have been approved. :)

Semi Concurrent
I-140 RD(01/29/2004) AD(11/02/2004)
I-485 RD(04/16/2004) AD(11/02/2004)
FP done on 05/04/2004
EAD and AP done on 05/14/2004

My company says that since my case is labor substitution case, it will be better for me to file I-485 only after my I-140 is approved. Is there any such rule? What is the relation between labor substitution and concurrent filing? Or is my company being stingy because in case my I-140 gets rejected, they don't need to spend money on I-485.

I don't want to wait for filing my I-485 because it will delay my wife getting EAD to work. Its my understanding that once my wife gets EAD, she can start working irrespective of when the I-140 is approved. Is this correct?
 
LUD change

The LUD changed 1 week before only on the I-485 application. It changed on 10/27/2004. I got email approval on 11/02/2004.
