I-140/485 Applied In December 2004

Received FP Notice

I rcvd the FP Notice today for both me and my wife. The FP ND is 02/01/05. The FP appt date is 02/17/05.

How much time does it take I-485 status to update after the FP is done.i got my FP done on 2/2 but still status of I-485 has not changed.

dont worry about I-485, worry about I-140 and yours is substitute. So I-140 is more important especially in CA service center, other service centers such as Vermont sub.I-140 also getting approved in 4-6 months.
mine is own and of sept. 2003, still no sign.

Now I-140 will be processed independant of I-485. New memo sent in Dec.04 to all service centers. So I-140 should not depend upon I-485.

you should ask your lawyer.

Looks like they stopped concurrent processing/approval. I recently got the I-140 approval after sending reply to RFE. No change in 485 status or LUD.

Atleast I am fortunate to get my 140 approval. Hope you guys will get the approval soon.

But why did u get RFE on your I-140? What they were asking ? can u please let us know the detailes query INS.

I got RFE on 140 for the following reason:-

1. Ability to Pay: The officer requested for a statement from CFO of my company to establish the prospective employer's ability topay the proffered wage.

2. Also requested for a fully executed uncertified labor certification[ form ETA 750, Part A & B ]

I received a mail requesting for more evidence/information on my I-140 application.I dont know how my case waws picked up this early.

My case is very similar to your's (RD 12/30/04, EB3 Sub Labor).
A few quick questions for you please:
1. Was your case filed with the California Service Center?
2. While filing your case, did you file with the ORIGINAL copy of the sub.labor
or was a photocopy used?
3. Can you please share the details of your RFE?

My case was filed in CSC.A photocopy of the sub-labor was provided.On the details of the RFE, I will have to get back to the attorney and find out.

Now since they have taken up the 140 case, does that mean that they would go ahead and process it now?

will start processing it. Once you reply to the RFE you may be approved soon.
I've noticed that in most cases...I repeat most cases (not all!)...a decision is made within 3-4 weeks. If your attorney filed your case with a photocopy of
the sub.labor instead of using the ORIGINAL copy, USCIS may request the ORIGINAL copy as part
of the RFE. Again, this happens in most cases and not all cases. Please do
update this group with the RFE details once you have them. Good luck to you!!

Finally Received Receipts

I received all receipts today..

Just checked the status online. Saw that there are LUD's for all applications.
The message is still same.
Can anybody tell if this is regarding the FP Notice or for any other reason?
