I 130 Please Help

Hi,

I am US citizen and my parents lives in India. I want to apply for their Green Card so that they can come here. Heres is the situation.


Father –age 58-Govt service pretty soon retiring
Mother –age 50
Brother age 15

Q. How many I 130 I need to apply? Is it two or three? Shoudl I apply I 130 for my brother even though he is only 15 years old?
Q. How can I apply for my brother who is minor ?
Q. My mother(only) will visit this month, should I apply that time or wait till she return?
Q. Can anyone please explain what are the steps I need to follow (I mean after I 130 approval) what next step I should do? Is it I 485 or what?

You file an I-130 for each parent, and one for your brother.

Your brother falls under FB4, which means his priority date should become current around the time he is 26-30.

You are best off filing an I-130 for your parents, and once it is approved NVC will schedule their interview in India. However, before you do so, you should consider how you expect your parents to have healthcare while in the US, and who will take care of your brother.

I heard something that if brother is under 21 (as dependent) and my mother is getting GC and coming to US then he(brother) will be able to come with my mother as a dependent.

is it true? Can anyone please clarify!

for the 100th time. the answer is NO!

When an US citizens petitions his parents for a Green Card, they CAN NOT, bring dependents, even if they are 1 day old.

PraetorianXI is correct - there are no derivative beneficiaries in Immediate Relative petitions.
 
So, which one will be faster if my mother comes(enter US) with GC and then apply for her son or I apply for my brother's GC?

You should apply for your brother's GC since you are a USC. It may make a slight difference versus if your mother (GC) had to apply for your her son (your brother).
