I-130 approval for my wife

Hi,

So I applied for my wife the I-130 in Dec 2022 and I have been tracking it every month and in May 2023 instead of the processing time changing to 6 months it changed to 3 weeks. Initially I was excited and I tracked it from 3 weeks to 2 weeks to 1 week and now it is showing "Your case is taking longer to process". Also per the receipt number my wife file was assigned to the Potomac Center and now it is Texas Center.

Does anyone know what is going on why did my processing time changed from months suddenly to weeks and now to no processing time. Before at least I had an idea of an end date to expect to hear back something by Oct/Nov 2023 and once it changed to weeks and now giving me "Your case is taking longer to process" I have no idea when to expect an approval or any sort of communication from USCIS.

If anyone can shed some light will be greatly appreciated

Yeah, these processing times shown are just estimated times. But I wonder why they changed it from 6 months to a few weeks? Let's see how it goes. I'll post here if I get any updates.

Yea I found it weird after the weeks went by. I tell you for 3 weeks my hopes where the sky the limit and then went crashing down
 
BTW, How or where do you check which service center has your case file? (Since you mentioned it was showing Potomac and now Texas center? I'm checking my case status on USCIS website and it only shows my progress and case history.

Well the receipt letter I received had the Potomac center. When it changed to weeks I called and was inquiring and they told me my file is at the Texas center. So seems like it was transferred
 
On my end, I'm a green card holder and we submitted the I-130 and AOS together back in October 2021 - we are both in the US; we've had a 2 RFEs, one for the medical and one for the I-130, but no news until now. We've had a weird email saying we hadn't submitted our medical, so I resubmitted our RFE responses in-person at our field office. I also see the "Your case is taking longer to process" status online.

Since then, we've even moved twice and we had a child.

Did you file yourself or do you have a lawyer?
 
Do you ask because you think USCIS processing takes longer? Because they want to be extra careful maybe? That’s what we are telling ourselves but only from anecdotal feedback of people in the same process.

We used a lawyer because the company pays for it, but in hindsight, we should have done it ourselves: typos on forms, waiting for the RFE for the medical that could have been sent with the package, one-size fits all process. Information on USCIS website, common sense and this forum’s resources are more than enough. Medical RFE was avoidable imo and 2/3 of the open points on the I-130 RFE were avoidable: we had to justify/expand on particulars of my wife’s past, irrelevant to our petition because lawyers like to play it safe and send way all information available.

Did you submit an advance parole request with the original AOS package? I have my EAD (DACA recipient), but have been married for years, and only now getting around to applying for my GC. Was hoping to request advance parole to visit in-laws, and didn't realize I might be able to do it together with the AOS application. Any insight much appreciated. thank you!!
 
So my status from "it's taking longer than expected to process your application" changed to 6 months again. Did you get any updates?
As of today mine still says "It is taking longer......"
How long did it take till changed I am just curious. Mine been like that for over a month

We sent the I-131 advance parole request later, early 2022, because we wanted to travel for Christmas but I don't think anything prevents you to send it with the original package with the EAD.
 
After 22 months, I see some light at the end of the tunnel. I-130 was approved a couple of days ago, hoping for I-485 to follow suit shortly.
FYI - I found a couple of websites with some sample timelines by the way for F2A concurrent filing for those doing AOS: here (multiple sources) and here (from Chicago FO).

So I checked the status Friday and there is a new in the Case History and My Progress tabs that said and I quote "Case is being actively reviewed by USCIS"
So that's a good thing but what does it mean from a timeline prospective

I just realized the final action dates for F2A retrogressed in April, downhill from there. Even with a i130 approved, we'll need to wait for our priority to be current (October 2021 in my case). It could take months/years until a visa is available. It might be faster for some of us to become US Citizen and update the petition category then.
 
So my I-129 petition for K1 Visa got approved after 15months last week but I have the I-130 spouse petition pending for 8 months now. I mean on the optimistic side scenario we have 1 year to 1.5 year for my wife to enter the US using the I-130 petition.
What do I in this case, can I use the approved I-129 petition to get a K1 Visa and then do AOS after the I-130 is approved in the future.

Any thoughts or someone was in this situation

Your approved I-129 is no longer valid if you’re already married as that petition is for a fiancé and not for a spouse.
