Hello,

My TN expires 11/29/2008. I have mailed my my TN extension form I-129, and now I can stay 240 days past the 11/29 expiry date.

My question to the people of knowldge is, can I travel outside the country now and after 11/29/2008? My job requires me to travel overseas often.

Thanks a lot

You'll need to reapply for a TN on re-entry, and bring your I-129 receipt to prove you have maintained valid status by a timely renewal petition. A pending I-129 does not allow for re-entrance.

Just to fully answer your question, you can travel and return from now until 11/29 without issue, your current TN is valid, and travel doesn't impact I-129 in any event.

But, as TRC sez, once 11/29 rolls around, you will need to re-enter US on a valid TN, which would be either your approved I-129 or the border TN you would apply for at that entry.

Remember that upon your return, you can ask the CBP officer to check if your I-129 is approved and if it is he will process you on that basis.

Also, if you do get a border TN, remember to write to cancel the still pending I-129.
