How to use EAD?

Hi All,

My H1 is going to expire within two weeks. I have valid EAD. I want to use EAD for same employer.
EB3(India) , PD April 2004, I-140 Approved, I-485 filed on 19th Jul 2007.
I have EAD and AP


My questions :
How can I activate my EAD?
What do I need to do to use EAD?
Do I need to inform USCIS that I am going to use EAD?
Is my employer has to do something?

This is my opinion based on my experience as I worked on EAD for past two and hald years. My employer asked for proof of work authorization and updated the I-9 form with the EAD's that I had.

Your employer will update the I-9 form.
In I-9 form, the proof for work authorization will be EAD.
Till you get your GC, keep I-9 updated with newer EADs as old EADs expires.

You got your answer... but, I would renew H1-B as back-up. It does not cost much but the benefits, peace of mind, are great. Just my opinion.

Best option is to file H1 extension and your H1 need to reach USCIS Before your I-94 gets expired.

They can know everything about you. If H1 Extension is not filed it means you are working on EAD (if I-485 pending) your pay stub has also info how much cut for tax or Social security and USCIS has excess to SSA.

You should update your SS too. Your employer will inform authorized places with your I-9 update, do not wory about that.

Update SS? Social Security? There is no need to update that for H1 -> EAD.

They know you are NOT using the H1, because it expired. They also know they issued an EAD to you.

That is the employer's responsibility, not the OP's.

of course thats employer's responsibility, but it also put you on the line where you can be question that you work illegally. and you have no answer because your I-9 is not updated.
