How to get Travel record from USCIS?

To all members,

I need my travel records since I lost my passport. I travelled to Canada once and it not require stamp at the port of entry when by land at that tme-no record. Is anybody know how to get travel record from US Immigration?

While I do not know if USCIS has travel records of every N400 applicant, I will say that missing stamps or (travel records due to lost passport) from a trip to Canada is not a problem. I travelled several times between USA and Canada during my GC days, and have almost no stamps for the record. I maintained a record on a spreadsheet and declared it on my N400. It was not a problem at all during the interview.

I would suggest that you declare your Canada trip on your N400 (best guess if you do not remember the actual dates), and do not worry too much about it.

You can request dates of entry from CBP via FOIA, but if you're only concerned about one trip, month/year format on N-400 is fine.

What should do if I do not remember the details on the trip to Canada? I drove cross border so not sure if have recorded. The point is not willing to get problem during N400 interview on Canada PR status though got it befoe US GC. What will they do if they find out my Canada PR status in N400?

Do you at least remember the year and how long it was for? Check your credit card statements for any purchases in Canada you made during the time to determine when it was.
 
I did a search in CBP's website FAQ and came up w/ the following:
CBP only has complete records of the entry and exit of persons arriving and departing by air or sea. If you are a legal permanent resident and crossed at a land border, it is unlikely that we would have a record of your travels. Also CBP's records only go back to 1982, even for air travel.

Information about someone's movements is protected by the Privacy Act and may only be released to the subject of the records or their designated representative.

Please print out the attached sheet below, fill it out and send it to:

U.S. Customs and Border Protection
1300 Pennsylvania Ave., NW,
Attn: Mint Annex Building, FOIA Division
Washington, D.C. 20229

If you are a designated representative of the person whose records are being requested, please also submit a form G-28.

Be sure to include in your request the approximate time frame of your entry and exits, your full name and date of birth, passport number and alien number. You must sign the request for information in ink. Unsigned requests will be rejected.

The process for researching our records is time consuming and as a result, there may be a charge for this service. If there is a charge, we will notify you of the amount in advance.

It takes some time to process these requests and depending on the backlog it could take significantly longer. There is no way to expedite the request, in order to avoid additional delays, make sure that your original request has all the requested information.

Canadian PR status does not affect US citizenship eligibility.Are they multiple lengthy trips that would put your US residency ties into question?

The computer systems of the immigration services of US and Canada are accessible to the border agents of both countries. They do cross-verify your status in the other country occassionally, particularly if you have the PR stamp of the other country on your passport.

If your Canadian PR has been kept alive by say a recent renewal of your Canadian PR card, then you will be grilled. However, if your Canadian PR card has expired, and you have given up Canadian residence, you are safe. I was in the second situation.

Yes, as close to reality as possible. No hiding - remember you will be under Oath at the interview. Also, if you have just one trip (or even a few), you need not worry at all.

You do not need to declare your Canadian PR status on the N400 as it is not asked for. However, you do need to disclose your travel dates.

They should not ask questions about Canadian residence, unless you have been maintaining residence mainly in Canada, or recently established permanent residence in Canada, and if this is the case, this will be evident from your current passport.

Thanks. Most of trips to Canada were weekend trip or holiday trips which last 1-2 days, max 1 week. - However, there are many trips, maybe 40-50 trips. - Is there a problem?

You'll likely be asked the purpose of the trips and why so many. Were the trips spread out over statutory period or over a shorter period lie a year?
 
Those were spreadout. It was really because living in Detroit and close to Canada. However, recent trip was from NY flew to Detroit and drive to Windsor to meet friend.
 
Couple times a month is alot? - Really do not want to bring in the question.. but have to list all the dates?
 
You'll have to list all the travel in question. if you don't remember exact dates, you could break it down by month.

Ex: 3/2005- 13 days in Canada
4/2005 4 days in Canada
 
I had like, 6-7 trips to Canada during the last 5 years and the agent asked me why I went there so often. Although I had lengthy (4-4.5 months) trips to another country twice, he didn't even care - but he asked me about my Canadian trips. I told him I had a sister in Canada and the issue was dropped.

So if you have a couple of times a month, it is very possible that they will ask you why you went there so often.

You have to list all the trips - that's required by the law/regulations. I listed all mine although there was no stamp in my passport as I traveled by car.

I had a grand total of 17 trips outside the US on my N-400 and 15 of them were to Canada. I guess my adjudicator did not have a "thing" for Canada :)

Although I had lengthy (4-4.5 months) trips to another country twice, he didn't even care - but he asked me about my Canadian trips.
 
Thanks. How to fill the form for trip? - Do they prefer 1) some dates on Form and the rest on Excel sheet or 2) every dates on excel sheet and note on Form "see seperate sheet''?
