Help needed!!! Very urgent

Hi everyone!!
Hope you having a good day. I have a very difficult situation and I was hoping someone can help me out with few questions. I have a political asylum interview on the 27th of December and I'm very nervous!! I have been waiting for this day for the past 7 months thanks to my incompetent lawyer. He fed me promises for the past 6 months. He was supose to send my application form in September but he only did it in the beginning of November. Today he told me that it will be a good idea if we will move the interview for a different date. He based this on the reason that its holidays and the getting a nice interview officer will be very hard, aka people will be pissed of that they have to work two days after Christmas. I dont know what to do ( I cant wait any longer, however he does not listen to me. I know my case however I have no idea how the interview will go and what sort of questions will be asked. My sister, who went through this 5 years ago, told me that we should let the lawyer go and just do it by ourselves. What do you think?? Anyone, please. Any adivce will be very appreciated!!!

That reminds me my application process. I sent my I-589 by the end of November and had my interview December 28. Guess what! I had the most shitty IO ever.He looked very tired, nervious and when his notebook stopped working at some point he was almost to cry as a little girl. I received a denial letter in 2 weeks and my case was tranferred to immigration court. But to be honest with you - I think that this guy was this type of "no approvals" IOs so the date of the interview didn't really matter. In contrary you can think about it positively. An IO can be in a good mood and he or she might wanna give you a Christmas and New Year present :) As far as applying by yourself without a lawyer I think it's a good idea. As a matter of fact you don't need a lawyer before your case is transferred to immiration court. If the guy doesn't do what he should do and he plays games with you I think you can let him go.

I think that I/O should be in a good mood due to the Holiday spirit and he wouldn't take 2-3 hour interview because he might be in a rush to get back to Holiday festivities. Just Greet him/her with a nice smile "Happy Holidays to you and your family" and thank him for taking the time for your interview during the Holiday season. IF this lawyer is no help now, I don't think he'll be much help during the interview but its your call. You know him better than I do. All I know is that, I wouldn't pay a moron for accompanying to an interview. Sounds like your lawyer has already some plans for holidays and is looking at this interview as mere inconvenience for him. I wouldn't reschedule your interview date as it can delay matters further and that would mean more money for your lawyer.

Thanks for your help. However, I have found out today that my interview will be rescheduled. Honestly, I'm in such a place right now that I dont really care of kind of answer they will give to me. Another month of doing nothing. The worst thing is that I have found two jobs and they are perfect for me. The employer told me that as soon as I will get my employment authorisation I can start. I guess now, cosindering the delay, I will lose both of them.

As far as I know you go to immigration court if your case is denied. Or did the rules change??
 
It looks like your lawyer is trying to make excuses to change the date for his own purpose. If I were you, I wouldn’t listen to him. If you already paid him to appear in court you should insist he go there with you and not change the appointment. If you did not pay him, you should go by yourself. Lawyers are not mandatory in immigration appointment but people take them just incase if the I/O asked inappropriate question. Usually they don’t ask you something out of you case that is inappropriate so you should be fine without a lawyer. Just relax and respond according to your case. Although these officers don’t show it, they are there to help you. So be yourself and do what you got to do. It is holiday so just like the other people in here advices you, they are more likely being nice than being rude to you. Even if they do, you have to be brave and take the chance. Good luck
 
you will not believe this...

My lawyer just sent me an email with attached letter "request for interview reschedule"... the reason and i quote "I cannot come on December 27th because I am sick I got flu."
this is ridiculouse!!!

I'm shocked!!!

Yep that's what I said. IO denied my asylum application and my case was transferred to immigration court.

no no... the letter is to reschedule MY interview, basically it is me who is sick with the flu...

I have a feeling the IO would not care if I'm sick... unless I got like an ebola virus or something...

PS I think Im going for it... by myself... man Im brave :)

Opell: First of all good luck. I hope you get a nice asylum officer who will give you the golden answer "asylum approved". Asylum interview by an asylum officer is not that bad. It is only you presenting your case and the asylum officer interviewing you. Most of the questions that the asylum officer will ask you will come from the asylum application form. Be prepared and don't be nervious or fearful. There are two out comes at the interview; either you will be granted asylum or refered to court for further hearing.

As far as the lawyer goes; there is one thing I want to caution you. Don't just wait for the appointment and just go there. You will need to take some concrete steps before doing that. You will need to get your lawyer stop rescheduling your appointment. Lawyers have certain legal rights over their clients, and unless you remove this legal right the lawyer could be a problem.

As far as lawyer goes, I think you should listen to your sister's advice. Go for it by yourself. Lawyers are good at court hearing, but the at asylum officers you can present your case just fine. I have seen couple of months ago two cases where one asylum applicant had a lawyer and the other hadn't the one without the lawyer won his case, where the one with the lawyer lost the case.

Just don't take any change and go for the appointment. You can't live under that pressure. also if you lose your case at the first hearing with the asylum officer you can hire a competent lawyer for the next hearing...

it really does not matter if you go with lawyer or not,

if your story makes sense and if you could convinvce the immigration officer

iam sure you will win, asylum is a gambling game, its always fifty fifty chance,

my initial asylum application was denied by officer first time, them i went

to immigration court with a lawyer, my interview date was december 23, one day before the chrismas, i was denied,

my lawyer adviced me to drop the case , i refused, i decided to appeal,

i prepared the appeal by my self, my lawyer mailed to me,

guess what, i won,

the whole asylum is gamble, just go for it my friend,

All else being equal it is very advisable to have an attorney go to an interview with you.

Did you attorney discuss with you the EAD implications of seeking a delay?

Merry Christmas to all of you :))

Just a quick question. I didnt have a choice but to reschedule my interview. I sent them the request letter and they got it on Friday 22nd December. My interview is originally scheduled for this Wednesday. How can I find out whether they changed the date?? Should I call the customer service tomorrow??
My lawyer said not to do anything, just wait for the reply, but I just want to make sure.

go wednesday to the the interview on time, there when you arrive the clerk will tell you if your interview has been re secheduled or not,

if they told you , your interview still on time, just do it,

you keep running from this interview, i really dont think you can run from it,
you are in,

just do the interview, be prepared wendesday,

in case you lose, get married from american citizen, this is the easy way to get CC,

forget this asylum crab, it just wasting time and a gamble

i recommend u to go with a lawyer . we dont know your case . there are some cases where u dont need a lawyer . . u can mess up your case so badly that u will be sorry for not taking lawyer for an interview. and and it wont be easy to prove your case in court .

thanks so much for your support. I am going with the lawyer. I heard that you can check your case status online, with the receipt number. I tried but it says that its invalid. Do I need to register first??

For your asylum interview or decision there is no way to track it or obtain its status online.
