HELP. Getting Married but Passport is with ICE

Complicated

New Member
Hi. Long time lurker. My passport is with ICE because they took it when they found out I overstayed my visa and put me in removal proceedings. TSA now checks identification and immigration issues even for domestic flights. So to make the story short, my american boyfriend who I've been with for almost 5 years and I decided to marry earlier than what we planned. My question is, we're trying to get a marriage license in the City of New York and get married there as he is from there but I don't have any forms of identification with me issued here in the US. My passport is with ICE. Do I just tell them that and show them my Notice to Appear for my Master Hearing? I have my Birth Certificate but no Passport. I believe I can't get a new passport from my country's Embassy because they just issued me a renewal.
Any clarifications and suggestions will be greatly appreciated. Thank you.

How long have you been in the US? TSA will only check your passport if you present it to them, because vast majority of us use our drivers license, which you should have applied for if you could... So, you gave them an opening by showing them your passport and letting them sniff you out and screw with you....;) Also, if you overstay your visa, what the hell are you doing flying across the country?

You cannot get married without an ID, simple! (unless maybe there is a state in the union which can issue a marriage license without need ti see ID) Your only option is to obtain another passport from your embassy or pay someone in your home country to send you an ID. Your birth certificate will be good for filing for a greencard which will be a humdinger of a process due to your removal proceedings which ICE initiated....

Also, it is for the first time I hear that ICE retains someone's passport...

Hi. I'm sorry I don't know how to do the quotation box. Thanks so much for your response.
I presented it as that is the only valid ID I have. I have a Labor Cert but it turned out my old lawyer is wanted for something unrelated to Immigration. I've done it before (presenting passport as proof that you are one and the same in boarding pass) on domestic flights. I never left the country as I have overstayed and still waiting for amnesty to adjust status. TSA officers are like immigration officers now. Even if you travel within the US. You feel like you go through a POE.
I already called my countrys consular office and they will help me.

Thank you very much for your responses. I really appreciate it.

TSA officers being like immigration officers now ?..I don't think so..they are far from being competent in that matter.
