H4 stamping in Mumbai

Hi all,

My wife has valid visa till Feb'2003 on passport but since I got my h1 renewal, we got another I94 till Nov 2005. If I send passport for revalidate it will take more time. My wife is going to India next month. Is it ok to get visa stamp at mumbai consulate? Will there any be problem?

Did you file H4 extension with your H1b extension? If yes then she has her H4 approval and valid I-94 till your H1B, if you have not filed her H4 extension than she is staying illegally as her I-94 expired in feb 2003, if you got her H4 extended then
Your wife can get her H4 visa stamp from Mumbai consulate. You have to send your H1b approval, copy of I-94, All the pages of your passport, Employer letter that should state that you are working with them, job title and salary. You have also to send complete I-29 petition including LCA that was sent to INS for your H1 renewal (your lawyer or HR has that copy, get that copy certified by the lawyer) send your recent 3-4 Pay stubs, W-2 and Tax papers (she should show only what is asked) she has to fill up form DS156 and Pay the Fees + Photograph (new style 2inch by 2inch) she can also take her H4 extension approval.

They can pick up her passport from home or she can visit the service center, one is in Andheri East other is near Hira Panna, HAZi Ali or she can use drop box at consulate. It is easy to go to service center as they are open up to 4 PM and you get your passport back in 3-4 days at your home or can collect from Visa services office

That is great information. I also applied for h4 extension and i have received it. So she is legal here.

can i send the attested copy of my i-797 (Approval notice)

H4 Visa

I also having case, want to stamp H4 for my wife. As Iam going back my home country will stamp mine as well. My company did not applied H4 for my wife and told me that "I can apply her H4 in home country US Consulate when revalidating mines".
Is this correct?

She is over stayed since March,03 in US, I would like to know that is it true I can apply for her H4, on base of mine H1B already approved. Experts suggestions are appreciated.

hkhan1 :you should have applied for the h4 renewal along with yours. This will be a question likely to come up in h4 processing.
