Hi,

I have a question that if a employer is not paying on bench(till the time he is on look out for a project with that employer) for a person after entering in US then will that person become out of status for H1B. Is there a limit on number of days on a person can remain on bench with valid status? Or this is a valid scenario and that person need not worry about that.


Till how many days can a person remain in status after entering in US on H1B. Or there is nothing like that

And more over how can that person ask for salary on bench. And if that person asks for salary on bench and employer refuses then what else can that person on bench can do? And that person dont want to loose his H1B in all of this.

File complaint with DOL and DOL will recover your wages and may fine the employer. Why they bring person on H1 status to US if they cant pay or dont have job? Ask for the payment. Bench or table is not allowed.
 
But still my question remains is that whether the person becomes out of status if the employer is not paying up on bench?
 
Yes, you are immediately out of status.

Are you sure about becoming out of status due to employer's inability to give work and pay? If it is true, then how does it affect the employee? after all it is NOT caused by the employee.

H1 employer bring you to work in US and Pay for that work. if no work or no pay you are out of Status and go back to your country or find new employer who can transfer H1 (if eligible).
