I requested my employer (consulting company) to apply for my H1B in premium process since my H1B application last year was returned on Aug 12, '05 (quota was over on Aug 10, '05). I had a great job (Software Eng.) in a big company but I had to leave it because my OPT expired. So, basically I didn't want to wait for 3-5 months to get my H1B approval and that's why I requested them to do it in premium process and they agreed. Now they are saying that USCIS has returned the $1000.00 premium processing fee as two weeks have passed and USCIS will do it in normal process now. They (employer) are saying that they are trying to convince USCIS people to process my application in speed process but USCIS people are saying 'what's the hurry?'. Everything is sounding fishy to me. In my understanding, as long as we pay the extra $1000 to USCIS, they would process the application in premium process. I have suffered a lot for this H1B and can't take this tension for 5 months until I get my approval. I would rather pay $1000 (which I asked my consultant firm to deduct from my pay check once I start working) and have the approval and sit in peace.
I just wanted to know if USCIS really refuses to process an H1B application in premium process any time.
