H1 transfer while Wife (H4) in India

Hi,

I am at a cross road. I am in a process of H1 transfer to a new employer while my H1 extension is in progress from my current employer. As per new employer my H1 transfer should be completed by this month end. Currently the validity on my passport stamping with the current employer's annotation is sept 2007. When my H1 is transferred, will the new 797 has an end date of SEPT 2007 ?

Also, my wife(h4)who is in India presently is returning on may 1st week. She has my previous employer's annotation on the passport stamping. Will this affect her return if my H1 is transferred by this month end ?

When my H1 is transferred, will the new 797 has an end date of SEPT 2007 ? End date may be 3 yrs or 1 yr more depends on how much yo consumed in your 6 yr initial period

Will this affect her return if my H1 is transferred by this month end ? H4 visa independent of your employer. As far as you have your H1 status valid she can use her H4 visa stamp to re enter US until it expires

--------------She can enter US with valid H4 visa. her H4 is tied to YOUR H1 status and not with employer A or B
Will this affect her return if my H1 is transferred by this month end ?

** she will get I-94 till her H4 visa stamp. you did not post till what date her H4 visa stamp is valid. if H4 stamp is valid till SEPT 2007 then she will get I-94 till Sept 2007. if your new H1 approval notice has I-94 attached till 2007 then file your H1 extension and her H4 extensions before I-94 gets expired. if you get H1 Transfer/extension more than Sept 2007 then file her H4 extension with USCIS BEFORE her I-94 gets expired.
