Please help!

I came to US in 1999 on a visitors visa did not go back to India since due to some personal problems, 1 decade:(
Then it was a sage for me ever since, changed to F1 then to H1 for residency and applied for GC got my EAD and AP (did not use them though). This year I would like to go to India, Hyd(getting very homesick) and get H1(I am in my 7th yr of H1) stamped in Hyd, instead of using my AP as my attorney wants me to be on H1 as long as possible(reports H1 is safer than using EAD). I am very concerned to get a H1 stamped as I did not trave for 10 yrs and all I have is an expired visitors visa stamp on my expired passport(my passport also expired and I renewed it in US)I have all documents with me changing my status legally, but did it here in US. My attorney does not see any problem with this. I am very skeptical to go to India for H1 stamping as I initially arrived on Visitors and changed status here.
Does anyone have any experience on this kind of situation, is it risky to go to India to get H1 stamped. God forbid they reject my H1 stamping in Hyd, can I still come back on AP or would that be a problem as my H1 was rejected. I need some kind advise please.

Thanks for taking time to read this.

Thank you very much for the reply RricS. I have a question though, if they reject my H1 will they stamp in the passport saying "H1 rejected". If so, would they not give me a hard time at port of entry. Thanks a lot.
