Hi,
My employer has been saying that he never got the H1 approval notice in the mail and I have submitted the 824 form and INS sent me an email that they have send me the notice some 15 days ago but my employer still saying that he never received it (probably lying). I am realy tired of this employer and would really want to transfer it out from him but cant. Any suggestions of what kind of legal action can I take against him (either sue him or transfer myself out)?
I would really appreciate of your comments
Thanks

If it is really lost in the mail (which is quiet possible), ask your attorney to apply for copy of the approval notice.

You can not sue your employer just for loss of petition approval.

Once you get the duplicate approval notice, think over it for couple of weeks before changing the job, because new employer may also loose the notice in the mail!!!!!

I do not get why employer has to lie for this case because there is no benefit for them to do so. Lost in the mails is most likely the case.
It's different from they lie for I485 or I140 approval.

Did you check with your lawyer ?

Thanks for all the suggestions. Just talk to the employer and he said that he got the approval notice in the mail like a week ago but never bothered to call me to end my worries. So i am gonna go and pick it up.

Thank you all
