Green Card holder PR mother gives birth to Child in US

Hello Everyone,

If a Green Card holder Permanent Resident mother gives birth to a child in USA makes her child a US citizen by law. Does it changes her status too to become a US Citizen? or it does not affect her status at all? Or she can apply to change her status after the child birth?

Any info appreciated.

It doesn't matter the status of the parents, if the baby is born in the US then the baby is a US Citizen and the status of the parents don't change at all.

The other way applies, if the baby is born abroad and if the baby's biological or adoptive parent(s) became a U.S. citizen before the baby reached the age of 18, then the baby becomes a US Citizen.

Her status stays the same and she can apply for citizenship after having the GC for 5 yrs. If she doesn't have a GC she can be sponsored by her child when the child is like 18 or older....The child is called an anchor baby.

If the parents have other kids who where born outside the US...they have to wait till the mother becomes a citizen (or father) if they are under age of 21.

She "IS" a green card holder. So that note about her being sponsored by the child is off topic. Besides, the son/daughter needs to be 21 in order to sponsor a parent (not 18).

If the mother is a Legal Resident she may petition for an unmarried son or daughter of any age. It would take longer but she can.

If giving birth in the US would entitle one to US citizenship, there would be an invasion of pregnant women from all Third World countries :D
 
The OP also has to keep in mind that there are people in Congress who are against anchor babies and are trying to get the law changed...so even if you get a baby now, by the time the baby is old enough to sponsor the parents, it might not be possible anymore....changes are slim for that to happen, but if some one get's a baby just for that reason and the law changes...that might be a hard blow.

all babies born on us soil regardless of parents citizenship or immigration status are us citizens at birth.
